Case is posted today for hearing on memo and the contents therein.

Heard, the advocates for the Complainant and Ops.

The advocate for the Complainant has filed a memo to withdraw the case against the Opposite Parties. But on the other hand the Opposite Party No.1(one) through did not object the same but submitted before the Forum that the case as per the agreement at the time of commencement of transaction if any dispute arising out of the case would be refer to the Arbitrator.

Hence the OP No.1 submitted that the forum has got no jurisdiction to entertain the petition and the OP No.2 did not objected the same memo filed by the Complainant.

In this context, in view of the above circumstances we are of the view that as per Sec. 3 of the C.P. Act, 1986, the insertion of Arbitration clause can not debar the forum to entertain the case because the particular provision of the Act is an addition to any other law for the time being inforce but not to any derogation to the same.

Hence, we are of the view to drop the case here.

Accordingly the case is disposed off.
