MR LAXMI NARAYAN PADHI, PRESIDENT… The facts of the complaint is that, the husband of complainant was a policy holder under the OP.s bearing policy no. 587648083 on dt.24.06.2010 with the OP.no.1 on term policy 165/15 paying premium of Rs.5940/- plus Rs.125/- as rider premium in total Rs.6065/- i.e. half yearly till 24.12.2024 and policy maturity date was 24.06.2025 and the sum assured was Rs.2,50,000/-. Unfortunately the policy holder died of cardiac arrest on dt.06.12.2012 and as such the policy being in force the complainant informed the OP.s by submitting all required documents along with claim form and bond but on dt.06.08.13 the OP through letter repudiated the claim of the complainant arbitrarily. Hence the complainant file the present case under compulsions claiming the sum assured under the policy with interest along with cost and compensation and any other relief as the Hon'ble forum deem fit and proper in the interest of justice.

2.         The counsel for OP.s filed his counter and stated that, the death of the life assured was intimated by the complainant through letter on dt.26.08.13. The said claim is under consideration and is pending for enquiry report entrusted to OP.s investigating officer. No repudiation letter was issued by the OP.s in any date or time as alleged by the complainant and fresh claim enquiry report is awaited from Berhampur division, a little more time may be taken for the settlement. Hence the delay is not intentional, so he prayed to dismiss the complaint in the ends of justice.

3.         The complainant and the lrd counsel for OP.s have been heard at length and perused the submissions and considered.

4.         From the record it reveals that the complainant being the wife of late Sudhir Kumar Padhy who is the policy holder supra and it is admitted fact by the OP that, the claim is genuine and the OP.s are contended that the settlement may take little more time but they denied that the claim of the complainant ever repudiated by them.

5.         Out of unwarranted contentions, we came to conclusion and ordered that, the OP.s are hereby directed to complete their enquiry and consider the claim of the complainant as per merit, and dispose the same within 45 days hence receipt of the order, with due communication to the complainant of the effect, failing which the complainant has liberty to take shelter before this forum u/s 25 & 27 of the C.P.Act 1986.

            Parties to bear their own costs.
