Common Oral Order in Consumer Complaint No.802 of 2015 + Consumer Complaint No.803 of 2015

In both these consumer complaints none present for the parties even on second call.  Today Complainants failed to appear before this Forum without any sufficient reason.  Perusal of the order reveals that Complainants were absent even on previous date viz. 27/12/2016.  Complainants have also failed to lead evidence as contemplated under Section-13(2)(b)(ii) read with Section-13(4) of the Consumer Protection Act, 1986; by filing their affidavits in compliance with earlier order dated 17/11/2016 passed by this Forum.  Thus, in these peculiar circumstances, it does appear to this Forum that Complainants have lost their interest in further prosecution of present consumer complaints.  Hence, it is not desirable to prolong these cases.  Consequently, both these consumer complaints stands dismissed for want of prosecution in accordance with provisions of Section-13(2)(c) of the Consumer Protection Act, 1986 read with Rule-4(7) of the Maharashtra Consumer Protection Rules, 2000.  Parties shall bear their own costs.
