Final Order / Judgement

ORAL ORDER

Per – Hon’ble Mr. V. P. Utpat, President

          We have heard the Complainant in person on the point of admission of consumer complaint at length.  With his help, we have also carefully scrutinized entire material placed on record.

[2]     Upon hearing the Complainant and on perusal of the pleadings of the Complainant, in his consumer complaint, it is revealed that Complainant has tried to raise a grievance alleging deficiency in service on the part of the Opposite Party in respect of a transaction of recovery of certain sum from him against the alleged dues pertaining to his credit card.  Admittedly, such amount was recovered from the Complainant during the period June/July-2008.  Complainant has filed the present consumer complaint before this Forum on 21/06/2016.  Thus, the claim of the Complainant for recovery of amount appears to be a stale claim.  Consequently, consumer complaint is hopelessly time-barred.  Moreover, no application is filed by the Complainant seeking condonation of delay for filing the consumer complaint and he has failed to put-forth before this Forum any just & sufficient cause for not filing the consumer complaint within the prescribed period of two years from the date of accrual of cause of action, as contemplated under Section 24-A of the Consumer Protection Act, 1986.  Hence, the consumer complaint is hereby not admitted and stands rejected in limine as barred by limitation.  No order as to costs.  Extra sets of complaint compilation are returned to the Complainant forthwith.
