1. By this complaint, the complainant has alleged unfair trade practise and deficiency in service against the O.P., ICICI Bank.
2. The complaint is that the complainant had taken loan from the O.P. bank and after paying few installments for some period, he closed his loan account by paying outstanding amount in lump sum. When he asked for No Due certificate from the O.P. bank, no action was taken and instead some more amount was demanded as outstanding dues. Then, when he approached to another bank for fresh loan, his request was turned down on the ground that his name is reflected in Credit Bureao Report and some dues of O.P. bank were still pending. Therefore he filed the complaint with a prayer to direct the O.P. bank to issue him No Due Certificate and delete his name from Credit Bureau Report.

The OP bank by its pursis dated 22/6/2017 informed the forum that in pursuance to the mutual settlement, the complainant has deposited Rs.25,000/- with the O.P. bank and the loan contract stood concluded on 24/8/2012. The O.P. bank has issued him No Due Certificate on 29/8/2012 and as such the complaint has become infructuous and needs to be disposed of.
4. The complainant even after receiving copy of the pursis did not file his say nor did withdraw the complaint. The counsel for the complainant has admitted that the O.P. bank has issued No Due Certificate and copy of the certificate is filed on record by the O.P. It is informed by the counsel for the complainant that though the OP bank has issued NOC, name of the complainant is still not removed from the record of CIBIL due to which he is unable to get fresh loan. In fact, to get his name removed from CIBIL the complainant himself has to apply with NOC of the O.P. bank. Besides, the O.P. has filed CIBIL Glance Report wherein no outstanding is shown against the name of the complainant since 24/8/2012 as the account was settled and closed. Thus there seems to be full compliance and redressal of his grievances. Therefore he is not attending the forum to say on the pursis. There seems no point in keeping the matter pending when the cause now does not exist.
5. For aforesaid reasons, the complaint is dismissed in default and for want of prosecution. Proceedings closed.
