This complaint coming on 1st day of April 2009 for final hearing before us in the presence of Thiru P. Subramani, Counsel for Complainant and the opposite Party has chosen to remain exparte and after hearing the complainant and having stood over till this day for consideration, this Forum passed the following order:
ORDER

1. The crux of the complaint is : -

The complainant and his sister had boarded the opposite party’s bus bearing Reg.No. TN 30 N 0041 at Madurai Arapalayam Bus Stand to Namakkal at 10.45P.M. on 08.07.2006. In the side of the bus it has been written as Dindigul, Namakkal, Karur and Salem. The conductor started issuing tickets, when the complainant sought two tickets to Namakkal the conductor stated that the bus will not stop at Namakkal, when the complainant queried the conductor for the reason he got enraged and abused the complainant.

At that point of the time, with intention not to precipitate the matter the complainant requested the conductor to stop the bus so that they can get down and board the bus which stops at Namakkal, but, the conductor refused for the same and issued two tickets each for Salem at Rs. 69.50 per ticket. Subsequently, the crew stopped the bus at bye-pass road without entering Namakkal and complainant was forced to get down there. The complainant states that due to the act of crew of the opposite party bus he suffered acute mental agony. The complainant alleges deficiency in service on the part of the opposite party and has lodged this complaint for compensation, cost etc.

2. The opposite party has chosen to set exparte.

3. The point for consideration is whether there is any deficiency in service on the part of the opposite party and if so what relief the complainant is entitled for?

4. POINT : The complainant to prove his case has filed proof affidavit along with document and the same has been marked as Exhibit A1.

5. The two original tickets has been produced and marked as Exhibit A1. if it is true that bus is not designated to stop at Namakkal, then the conductor of the bus ought to have requested the complainant to get down from and board the bus which stops at Namakkal, but he has not done so.

The act of the conductor of the opposite party in issuing the complainant ticket for Salem, when they had sought ticket for Namakkal is highly improper and unlawful. The complainant had stated that subsequently the bus crew stopped the bus at Namakkal Bye-Pass Road without entering Namakkal Bus Stand and the complainant was forced to get down there. The complainant ought to have alighted the passengers at Namakkal Bus Stand, but, instead the crew have downloaded the complainant at bye-pass road. The complainant and his aged sister were thus forced to travel back to Namakkal bus stand through separate bus. The crew of the bus for the foregoing reasons had committed deficiency in service. The act of the crew of the opposite party bus would have definitely caused acute mental agony to the complainant and as such the complainant is entitled for compensation on account of mental agony. In view of the above discussion we hold the act of the crew of the opposite party bus as gross negligence and deficiency in service. So, we hold that the opposite party is liable to pay Rs.1,000/- as compensation for mental agony and to pay Rs.1,500/- towards cost of the complaint to the complainant. Point is answered accordingly.

6. In the result, the opposite party is directed to pay Rs.1,000/-(Rupees one thousand only) as compensation for mental agony and to pay Rs.1,500/- (Rupees one thousand and five hundred only) towards cost of the complaint to the complainant. Time for payment one month from the date of this order.

This complaint came before us for final hearing on 18-11-2009 in the presence of Thiru A.Mohamed Hussian, Avocate for the complainant and Thiru T.Selvaraj, Advocate for the opposite parties and having stood over till this day for consideration this Forum made the following:

    ORDER

This complaint is filed under section 12 of Consumer Protection Act 1986.

    1) The averments of the complainant in the complaint are briefly as follows: The complainant is a practicing advocate at Tirunelveli. On 16-5-2006 he wanted to go to Chennai in connection with a case at Madras High Court at 8.00 P.M on that date he reached the Tirunelveli new bus stand. Bus No. TN 01 – N 6736 which belongs to the opposite parties bound for from Marthandam to Chennai came there and the conductor of the bus told the complainant that it is a super deluxe bus which would reach Chennai on the next morning between 9.00 to 10.00 A.M. Believing the words of the bus conductor that the bus would reach Chennai in the morning on the next day, the complainant along with one person boarded in the above bus and they got tickets for Rs.476/-, each for Rs.238/-. Bus started from the Tirunelveli bus stand at 8.30 P.M. and reached the Trichy State Express Bus Depot at 3-15 A.M. on the next day the conductor of the bus told the passengers that it would take 15 minutes for the bus to start since diesel has to be filled up and told the passengers that if they want to take tea or coffee they could very well get down from the bus and wait for 15 minutes. After 12 minutes the complainant enquired the bus conductor when the bus would start from there but the conductor of the bus told him that his duty time is over and other driver and conductor have already taken the bus to Trichy bus stand, where the complainant would get the bus if he immediately went there by auto rickshaw. The complainant along with other persons went to the Trichy bus stand and searched the bus in which they have travelled. Since the bus was not available there they enquired with the time keeper of the State Express Transport Corporation regarding the bus, who told them that the bus had already proceeded to Chennai. He complained the matter to the officials of the State Express Transport Corporation at Trichy bus stand and they arranged to send them in another bus which is not a Super Deluxe Bus, this caused much inconvenience to the complainant and mental agony. The complainant along with other reached Chennai only at 1.00 PM on the next day. Hence he could not attend the work for which he had undertaken the journey hence the complainant has filed this complaint to direct the opposite party to pay Rs.20,000/- as compensation for the mental agony and Rs.60,000/- for the deficiency of service on the part of the opposite parties and Rs.20,000/- towards loss and the cost of the complaint.

    2) The averment in the counter filed by the 1st opposite party adopted by the 2nd opposite party are as follows: The complainant is not a consumer and he cannot file this complaint under Consumer Protection Act. The fact that on 16-5-2006 the complainant along with another boarded the bus at Tirunelveli bus stand for Chennai has to be proved only by the complainant. The complainant has to prove that on the next day at 3-15 P.M. the bus reached the State Express Transport Corporation workshop at Trichy and the conductor told the passengers that since diesel has to be filled up for the bus it would take another 15 minutes and those who wants to take coffee or tea can get down from the bus and do so. It is also for the complainant to prove that after 12 minutes he enquired the bus conductor regarding the departure of the bus and that the conductor told him that the bus was already left for Trichy bus stand and the complainant along with others immediately went into an auto rickshaw to the Trichy bus stand and searched for the bus. The complainant is not entitled to get any compensation for the amount for his mental agony and for the deficiency of service on the part of the opposite parties. This opposite parties enquired the conductor of the bus one Thiru K.S.Sheylie regarding this incident. He told them that after filling up diesel at Trichy workshop the bus was taken to the Trichy bus stand and he waited in the workshop for sometime for three passengers who have traveled in the bus but not occupied seats when the bus started, and after giving information with the time keeper they have taken the bus to Trichy bus stand. There also they have waited for 30 minutes and since the three passengers who came in the bus were not turned up, they left the bus stand after giving information regarding this to the time keeper. When the bus was stopped at Tindivanam bus stand for taking refreshments three persons who came there by Tuticorin Chennai Express bus boarded the bus and they got down at Chennai. This particulars have been mentioned in the passengers travel particulars. This complainant along with two passengers were permitted to travel by Tuticorin Chennai Express bus from Trichy bus stand without getting any new tickets and on the streng1th of the tickets already taken by them for Marthandam Chennai Express. In stead of appreciating the gesture shown by the opposite parties, the complainant has filed this complaint requesting for payment of compensation. At the Trichy State Express Transport workshop and also at Trichy bus stand the conductor and the driver of the bus waited nearing 15 minutes for the three passengers who were not boarded the bus and they have left the Trichy bus stand after giving information to the time keeper. Hence the complainant is not entitled for the compensation from the opposite parties and the complainant along with the others have boarded the same bus at Tindivanam Bus stand and reached Chennai at the schedule time. Hence there is no deficiency of service on the part of the opposite parties and the complainant is not entitled to get any relief asked for. Hence the complaint is liable to be dismissed.

    3) The points for consideration in this case are;

    1. Whether there is any deficiency of service on the part of the opposite parties and if so;

    2. To what relief the complainant is entitled to?

    4) Points: The case of the complainant is that he along with others boarded a super deluxe bus at 8.00 PM on 16-5-2006 at Tirunelveli Bus Stand for Chennai and the bus reached Trichy State Express Transport Corporation workshop at 3.15 AM on the next day. When the bus went into the depot for filling up diesel, passengers who opted for taking tea and coffee got down from the bus and complainant was also one among them. After 12 minutes when he enquired with the conductor of the bus as to when the bus would proceed, the conductor told him that the bus in which he was a conductor had already left for Trichy bus stand and if the complainant reaches the bus stand immediately he can get the bus. Immediately the complainant along with others went to the Trichy Bus stand where they found that the bus had already left for Chennai. Hence the complainant was forced to travel in an ordinary bus from Trichy to Chennai which caused mental agony and since he could not reach Chennai at the schedule time of 9.00 to 10.00 AM, he could not attend his duties, causing loss. So he has filed this complaint for compensation of Rs.1,00,000/- under various heads.

    5) On the other hand the opposite parties would contend that they enquired the matter with the conductor of the bus in which the complainant had traveled from Tirunelveli and found that the complainant along with two others were missing at Trichy express workshop and subsequently at Trichy bus stand. The conductor and the driver of the bus waited nearly for 30 minuets for the arrival of the missing passengers and since they could not reach the bus within the extended time they were left with no other alternative except to proceed to Chennai. At Tindivanam bus stand whether the bus was stopped for refreshments the complainant along with two others who came there in another express bus boarded the same bus and reached Chennai at the schedule time.

    6) Counsel for the opposite parties would contend that the complainant along with other two persons had left to a far off place for taking tea or coffee and they have missed the bus at Trichy Express Depot as well as Trichy bus stand. The complainant and two others were permitted to travel from Trichy by another bus of the State Express transport corporation by the officials of the opposite parties on the strength of the tickets they have already purchased and they got the bus in which they were traveled before, at Tindivanam bus stand and they boarded in the above bus and reached Chennai at the schedule time. Since the inconvenience caused to the complainant and others was because of the mistake committed by the complainant it cannot be said that mental agony and loss was caused to the complainant for the deficiency of service of opposite parties.

    7) To prove the case of the complainant proof affidavit was filed and Ex.A1 was marked. Ex.A1 is the tickets purchased by the complainant and others. On the side of the opposite parties, 1st opposite party was examined as R.W.1 and the conductor of the bus in which the complainant traveled from Trichy to Tindivanam was examined as R.W.2 and Ex.B1 was marked. R.W2 has stated in his proof affidavit that he was conductor of Bus No. TN209 route no.170 bound for Chennai from Tuticorin and the above bus reached Trichy bus stand on 17-5-2006 at 4-00 AM. He has further added that the time keeper at Trichy bus stand told him to permit three passengers who have missed the bus No.5188 under route No.1794 to travel in his bus on the strength of the tickets they have already purchased for route No.1794and when the bus reached Tindivanam bus stand the bus in which the complainant and others traveled earlier was there and the complainant and others got down from his bus boarded the bus in which they have missed at Trichy. In Ex.B1 is the passenger travel particulars of the bus in which the complainant and others traveled from Tirunelveli to Chennai in which it has been stated that the three passengers who missed the bus at Trichy boarded at Tindivanam. Hence the allegation of the complainant that they reached Chennai on the next day at 1.00 PM by another bus does not seem to hold good. When the bus stopped at Trichy State Express Transport Corporation Workshop for filling up diesel, the complainant along with two others missed the bus, subsequently they were permitted to travel in another bus of the opposite parties on the same tickets they have purchased earlier and they got the bus in which they traveled earlier at Tindivanam bus stand and boarded in the same bus. This has been proved by Ex.B1. The counsel for the opposite parties would contend that in stead of appreciating the gesture made by the opposite party’s official the complainant had come with false allegations against the opposite parties and he is not entitled for any relief as asked for. When the bus stops in a bus stand or any other place the passengers who travelled in the bus have to be vigilant regarding the departure of the bus. The argument of the complainant side counsel that the conductor of the bus should have verified whether all the passengers have boarded the bus before it is proceeded, does not hold good for this case, because the case of the opposite parties is that at the Trichy Express Bus workshop and also at Trichy bus stand the officials of the opposite parties waited for some time for the arrival of the missing passengers, since they could not reach the bus within the extended time it cannot be said that the officials of the opposite parties took the bus without verifying whether all the passengers have boarded or not. The officials of the opposite parties cannot wait for the arrival of the missing passengers indefinitely.

    8) In the circumstances stated above we come to the conclusion that there is no deficiency of service on the part of the opposite parties and the complainant is not entitled to get any relief as asked for.

    9) In the result the complaint is dismissed. There is no order as to costs.

On 08.08.10 (Sunday) evening when I was returning from Vellore to Chennai along with my family, Near Balu Chetty Chathram (On Bangalore – Chennai National Highway) all the vehicles were forced to stop for clearing an accident vehicle by the police. During that time, I also stopped my vehicle (Maruti Alto – TN 20 AT 7670). At 08.45 p.m., a Government bus (TN 23 N 1801) heading towards Chennai had hit my car on the right side causing severe damage on my vehicle and the bus driver didn’t stop at all.

Then I got down from the car to check for any injuries to my family members and damages for the car also.

After that I have given my car in the Maruti Service Masters in Ekkattuthangal, Chennai for Insurance claim. Now they are telling that it will cost me around Rs.5000/- even after insurance coverage.

Not only on the money part, but for humanitarian aspect, the driver doesn’t have the courtesy to stop the vehicle to check for any human casualties and simply he left.

Requesting to take necessary action on the concerned driver who drove on that particular time.

    Thanking you,

I traveled by 102 Express from Vellore to Chennai on 18 Jan 2011 by 1445 hrs from Vellore.
While after crossing Kanchipuram , our bus (TN72N-1336) was on right lane. One State Deleux Bus ( TN01-5109; coming from Bangalore), was approaching to overtake us from left lane, one AUTO rickshaw was plying alongwith our bus. All of a sudden the Delux bus overtook us and OUR VEHICLE DRIVER WAS VERY SMART ENOUGH TO CONTROL THE VEHICLE, he immediately applied brake.
The Delux bus, in the process hit our bus in the left corner & the rear view mirror was stripped OFF.
We managed to get the Deluxe bus near the TOLL GATE at Sriperambudur, wahen we enquired the other bus Driver, he happens to be in DROWSY MOOD (that's what everyone of us felt)
In this process the bus passengers were all Lucky enough to escape from a MAJOR ACCIDENT.
REQUESTED TO DO THE NEEDFUL AND AVOID SUCH REOCCURENCE

Sir, a town bus at 8.20 a.m. from Sankarankoil to Vellappaneri via Panavadali Chathiram (reachable at 8.50 a.m.) is regularly activated. Except Monday, in other days, that bus time is very useful to the teachers working along the ways from Sankarankoil to Vellappaneri. But only on Monday, the driver of that particular bus is not considering the school teachers to carry in and he is activating that bus 10 to 15 minutes earlier. So, the teachers those who are coming from Nagercoil, Vallioor and Tirunelveli (My wife is from Tirunelveli) are unable to catch that bus at Panavadali Chathiram because our TNSTC SFS bus reaches there around 8.40 to 8.45 a.m. Other main thing, there is no other way to reach Vellappaneri except 8.20 a.m. town bus from Sankarankoil. So, I kindly request you to make necessary action to maintain the timing on Monday also as it is followed on other days. Thanking you.

Reference: Advance Ticket Reservation PNR no. L50891561161 Ticket No. AZ719670

    Sir/Madam,

Our family traveled from Hosur to Chennai vide the above ticket on a TNSTC-Salem division bus (Bus Route No. 475F) on 02-October-2011. The bus left at Hosur at 22.30 hrs on 02-October-2011 and reached Chennai Koyembedu Terminus on 03-October-2011 at around 4.20 AM. The bus was stopped in the rear entrance of the terminus (opposite to Koyambedu market) and the bus conductor told us to get down as the bus reached Koyembedu. The passengers started to get down one by one; my wife and my younger son got down first. My elder son and myself were about to get down, but all of sudden the bus driver started the bus and moved on without any reason. I told the driver and also through the conductor that we still needed to get down and my wife and other son got already down. He turned down our request and did not stop the bus. The conductor also told the driver to stop the bus as part of my family already got down, but the driver did not obey the conductor's words. The driver also abused us with unpolished words. Finally the driver stopped the bus after 300 meters away from the place where he previously stopped.

It was very unfortunate that my wife stranded in the crowd along with the young child without me. Finally I got down, walked upto the distance and searched my wife in the crowd.

The driver's action was totally unwarranted and intolerable. Request you to take this issue up to the concerned higher authorities and to initiate appropriate discipline action against the driver.

    Thank you.

Tamilnadu govt. Announced bus fare hike up to 75%. But yet to declare list of ticket fare. Now a days they charged rs.1000/-pm instead of rs.600/- bus pass. Really i cant bear this bus fare hike immediately.
I request to reduce bus fare and use normal bus for journey.

    Respected Sir,

11th Dec 2011 (Sunday night) - I have traveled with my family by using Express BUS from CHIDAMBARAM to Bangalore. Bus No. TN32N3319 VILLUPURAM DEPO Bus. Ticket No. 046327

    Main problem.

Bus driver was not felling well. So driver slept for ½ hours. Then he started the buss – because he was not well Same reflected In his driving. He took the buss till neyvaliy and stoped in between naively and BANDRUTI.. He was suffering from chest pain like heart attack. One of our passengers called 108. Driver moved to G.H PANRUTY. Conductor have arranged new driver. I am not pointing any mistake on driver. He could have told no to drive and arrange for other driver. But he is not done. Passengers not worried about delay -- Because passengers worried about their safety and than drivers health.

    Sub Problem :

Bus is not cleaned inside and outside both.

There is no first aid box.

Luggage carrier is in very very bad conditions. Almost like falling on passengers head.

Bus seat condition is very bad.?

I don't want any companstaion. Who have done the fault should be identified thru investigation and should be punished.

    My question is ?

1.Why the driver not changed at the beginning. ?

    2. Is he given proper rest. ? Particularly who is driving on the nights ?

    3. Why conductor not advised driver to take rest?

    4. Why bus is not maintained properly?

    5. Private busses are doing well with few bus and routes. Why corporation bus are in the very bad condition. ?

    6. Why Corporation is not investing more on projects like Mamandor ? Why ladies travelers suffering are ignored regularly? Long travelers

    7. People are traveling around 300k.m by standing and sitting the floor. ? Why there is no exacta services on Sundays.

    8. Corporations should be an autonomic body under control of Government. There should not be any polical interventions. Because personally I know ex.Transport minister Took 1.5 lack for driver posting from one of my relative.

    10. We are ready to pay the bus fares what u are charging . But where is the basic service. Where is the basic required quality ?

    11. Why you are treating the passengers like buffalos?

    12. Why there is no complaint register from corporation?

    13. There should be a system like flying squads should check surprisingly and regularly and also should take complaints from passengers and drivers on their issues.

    14. Please arrange regular health checkups for drivers. Like yoga , mediations would help them to improve their health.

    15. Please encourage them to play some games like table tennis. To improve their health. Drivers mostly suffered on stress related issues. My relatives suffering on diabatis and one died in heart related problem.

    16. People doesn't have time to go for Consumer court. ? If all go What the answer from transport corporations.

I have return such complaints before also some issue like Bed bugs in SETC. Transport corporations should not engage private and other state transports.

My intention is to improve the quality of transport service. At least People should not have any basic problem like this. Simple quality service should be provided. People should be prod on Tamil nadu state transport bus. i have sent the same mail to tamil nade CM cell also. I don't have time to go for consumar court and file RTI, i have to take care of my family between this problems and my problem. By seeing suffering of poor and innosant public people am writing this complaint.

Please ignore, if my words effected anyone or any mistake.

    Thanks & Regards,

    Premkumar.

We are travelling from tirupathi to Chennai in Bus No (Tn 01 -n- 1352)on 1.2.2012(5:00 PM) in the route No 201. Once we entered the bus conductor asked us to get the token for the reservation. At the reservation counter the officer issued a wrong route no reservation tickets.Once we asked him to change the route no he asked another 10 Rs to issue the token and we got the token by giving another 10 rs .Again inside the bus the conductor charged normal charge. When we enquired him he used filthy langauges .Expecting concerned authorities to take the neccessary action on the token counter officer and why the token system is followed apart from the normal charges ???????????????

Respected sir, for 22 of jan 2012 I reserved ticket from tirupathi to trichy 8.30pm ultra deluxe service in online. I've to come from kurnool to tirupathi to travel in that. It became late due to late approach of bus. At 8pm I called to setc counter of tirupathi & informed about my problem. The told that 50% money will be refunded. I tried to cancel ticket, but there was no option to cancel the ticket. Next day I called SETC helpline & informed them, but they are saying that ticket should be cancelled before 4 hours. While reserving ticket i didn't get such terms & conditions. All other state R.T.C will refund money. I dont understand why setc is doing so. I've attached ticket along with this. So pease refund my money kindly.PNR N􀁘mbe􀁕 : T1678750

    Hi,

Everytime while travelling from bangalore to salem, govt buses are stopping at some hotel near kaarimangalam (near dharamapuri). From the intial days i felt that conductors are purposfully stopping there, but later i came to know that , that particular hotel is taken contract from govt. (same message i got from the hotel owner).

The food items whatever they are providing is not good to have.

Now a days people are ready to spend money to have proper food. but due to the govt. contract we are forced to take the inhygenic foods..

Govt should cancel the licenses of the hotels, & they have to do the periodic check.

    Regards,
    sathiyan

    I m Veerakumar staying 4/132, Amman kovil street, , Vadambacheri., Sulur TALUK, Coimbatore,Tamilnadu - 641669

In the date of 8/6/2013 i have travelled in government bus (105 c) from Vadambacheri to Sulur around 10:15 AM to 11:00 AM. When i tried to sit in the seat the sharp point of bolt on my front seat teared my pant. There are many seats having the same problem. This is the second time in this week in the same bus. Due to a poor maintenance of the concern department, causes a loss of 2 pants around 1100 rupees. The cost of the pant may be refund by some other way, but as a professional person how can i suppose to go to my job with a noticeable hole in my pant. In case of children there may be possibility of injury followed by infection. This is to be taken care this after. As a public representative we need a good service for our money.

Here with i attached my travelled ticket, photo snaps of the sharp points of the bus seat and teared pant.

I have complainted about this in cmcell in 8/6/2013. But still i don't get any reply from the concern department. IMG_0796.jpgIMG_0801.jpgIMG_0802.jpgIMG_0799.jpg

We are travelling everyday from Sholinganallur to kelambakkam in B19 bus.At Sholinganallur bus-stop the bus overloads itself with people that there is no chance of even breathing inside the bus.People are (students eps) are hanging out of the bus which is very dangerous for everyone. Please provide more no of buses or else ask the drivers not to overload people in the bus, else manufacture buses in such a way that if the bus is overloaded the bus engine should not even start unless the bus load is maintained (similar to elevators).
Looking forward to your quick action on this issue.

    Thanks !
