The case pertains to deficiency in service as envisaged under the provision of Consumer Protection Act and its brief fact is as follows:-
The Complainant purchased a Honda Unicorn motor cycle bearing Engine No. KC09E-4027299 and Frame No. ME4KC098G-78024639 on Dt. 31/07/2007 bearing Regd. No. OR-17-E-6281 on a sale consideration of Rs. 67,876/-(Rupees sixty seven thousand eight hundred seventy six) only from the 3rd Opposite Party, dealer with the Ist Opposite Party as manufacturer. As per the technical specification of the motor cycle provided by the Opposite Parties, the said motor cycle should give mileage of 60(sixty) Kilometer per liter but from the date of purchase the motor cycle is giving 25 (twenty five) to 28 (twenty eight) Kilometer average per liter. The Complainant repeatedly approached the 3rd Opposite Party. On advise of the service engineer at Bargarh, the Complainant took the motor cycle to the Second Opposite Party for 8(eight) items in between Dt. 15/10/2007 to Dt. 05/05/2008. The Complainant has also left the vehicle at the workshop of Second Opposite Party at Sambalpur for 7 (Seven) days for repair and solve the mileage problem. Ultimately the Second Opposite Party could not solved the problem and so the Complainant approached the Ist Opposite Party, manufacturer of the vehicle.
The Complainant contends that in spite of best effort of the service engineer of the Opposite Parties the low mileage problem of the motor cycle was not removed which apparently a manufacturing defect.
There after the Complainant on Dt.26/05/2008 send pleader notice through his advocate to replace the defective motor cycle, which was replied by the Opposite Parties on Dt. 23/06/2008 for further check up of the vehicle.
The Opposite Parties have sold the motor cycle having inherent, incurable and manufacturing defect putting unnecessary harassment and monetary loss to the Complainant. So the Complainant approached this Forum claiming compensation for deficiency in service on the part of the Opposite Parties. Thereby the Complainant claims for replacement of the motor cycle in question by providing a defect free new brand motor cycle or to pay Rs. 67,873/-(Rupees sixty seven thousand eight hundred seventy three) only towards the price and Rs. 32,000/-(Rupees thirty two thousand) only compensation towards mental agony and litigation cost, with interest.
The Opposite Parties filed written version stating that, there was no manufacturing defect in the motor cycle in question and the Opposite Parties has attended all complaints to the utmost satisfaction of the Complainant. As such there is no any deficiency in service on the part of the Opposite Parties. The Complainant has alleged that the vehicle is not giving the mileage as claimed by the Opposite Parties. Mileage of a vehicle depends upon so many factors such as driving condition, road conditions, load conditions, air pressure etc.. The alleged Complaints if any, caused are due to the latches or lapses on the part of the Complainant. In Order to satisfy the Complainant, minor adjustments were done from time to time even changed the carburetor free of cost.
The vehicle was checked in the presence of the Complainant and has already conveyed his satisfaction over the Jobs per formed by the Opposite Parties. Since there is no any inherent technical defect or manufacturing defect and the Opposite Parties has attained all the complaints to his satisfaction there exist no ground for claiming replacement of the same or claiming compensation or any others relief as claimed in the complaint.
The Opposite Parties prays for dismissed of the complaint with cost.
After conclusion of the hearing of the matter the Advocate for the Opposite Party filed some copies of documents which was not taken into consideration.
Perused the complaint petition, Opposite Party's version as well as copy of documents filed by the Parties in respective of their case and find as follows:-
Purchase of Honda Unicorn motor cycle from the Opposite Party No.3(three) dealer of the Ist Opposite Party the manufacturer, for a sum of Rs. 67,873/- (Rupees sixty seven thousand eight hundred seventy three) only is not disputed by the Opposite Parties. The Complainant has purchased the vehicle with a hope, the motor cycle will give 60(sixty) Kilometer per liter as claimed by the Opposite Parties. But the vehicle gave a poor mileage. The Complainant made complain before the Opposite Parties to solve the problem of poor mileage. The Complainant made complaint as many as eight times about the poor mileage which also proves by the certificate Dt. 05/05/2008 of service manager of the Company. It is also not disputed that the Opposite Parties has attained all the complaints of poor mileage of the vehicle in question and removed the carburetor free of cost. The Opposite Party No.2(two) kept the vehicle in his workshop for seven days. But still the problem of poor mileage of the vehicle was not removed. Which proves that there is some inerrant defect in the motor cycle.
As the said motor cycle has got manufacturing defect, the Complainant served pleader notice Dt. 26/05/2008 to the Opposite Party No.1(one), the manufacturer requesting either to replace the motor cycle of a new one or refund the price of the motor cycle but on Dt. 23/06/2008, the Opposite Party No.1(one) asked the Complainant by letter to again checkup the vehicle in their Bargarh or Sambalpur service station. The Opposite Party has also not denied regarding 60(sixty) Kilometer average per liter of Petro as per the technical specification of the company.
After several complaints of poor mileage made by the complainant was attained by the Opposite Parties and also after keeping the motor cycle to seven days in their work shop for testing the poor mileage problem as per their technical specification of Honda Unicorn motor cycle could not be rectified by the Opposite Parties due to inherent defects of the motor cycle which amounts to deficiency in service on the part of the Opposite Parties.
In view of above discussion the complaint is allowed and order as follows:-
The Opposite Parties are directed jointly and severally to refund the purchase price of the Honda Unicorn motor cycle i.e. Rs. 67,873/-(Rupees sixty seven thousand eight hundred seventy three) only and a sum of Rs.5,000/-(Rupees five thousand) only to the Complainant, as compensation and litigation cost of the case, within one month from the date of Order, failing of which total amount will carry 12%(twelve percent) interest per annum till the date of payment.
The Complainant is directed to handover the defective Honda Unicorn motor cycle bearing Engine No. KC09E-4027299, Frame No. ME4KC098G-78024639 and Regd. No. OR-17-E-6281 to the Opposite Party No.3(three), on receiving of the amount from the Opposite Parties.
Complaint allowed and disposed of accordingly.

    ORDER

    1. The Complainant purchased a black colour CBF 150 Model HMSI Honda, Unicorn bike having chassis No. 4 KC 094 L 480 12813 Engine No.KC 09 E 0013787 from the 2nd opposite party on 26.11.04 by paying Rs.52,639/-. The said bike registered vide Regn. No. is TN 41 P 0151. The 2nd opposite party owner's manual and 1st opposite party gave warranty card to the complainant. From the date of delivery of the said bike did not run smoothly and it gave more troubles. So, immediately, within a week the complainant approached the 3rd opposite party and explained the irregular performance of the said vehicle. The 1st opposite party has given the bike with manufacturing defects, the 2nd opposite party in turn sold the bike to 3rd opposite party. The 3rd opposite party sold bike with manufacturing defects to the complainant.

    2. The complainant on 16.12.05 sent a fax message to the 1st opposite party by pointing out the major manufacturing defects of the bike such as disk break failure, broken seat tail piece, speedometer cable was cut off for three times, break pedal clearance is too less, stand also hits the ground, when breaks are applied. Head is not fixed well hence noise is coming, leakage in petrol tank, ignition key fault and the key was replaced two times by 3rd opposite party. Further more the crank-shaft noise and clutch noise and the steering racer automatically gets tighten up and spares were not property replaced, because of non availability and poor supply by opposite party. The complainant has spent about Rs.400/- for each time for transporting the bike from his place and also he sustained business losses.

    3. In the past two months the 2nd opposite party has replaced the following parts, the petrol tank once and the replaced one is also leaking, engine cylinder got cracked, shock absorber is weak, ignition key was replaced for 4 times and the break shoes got jammed while the bike is running. Because of the last said defect the complainant bike exhaust huge smoke. The warranty period expires in the month of January '07 and further the bike has run only 23,000 K.M. The bike is covered by the warranty. The complainant issued legal notice dated 14.03.06 to the opposite parties and they received the same. There was no reply from them and hence the complainant has filed this complaint.

    4. The complainant file a complaint before this Honourable Forum and if had numbered as C.O.P. No. 154/06 against 1st and 3rd opposite parties and the same was not pressed by the complainant for the reason of many changes dealer, on 30.01.07 and this Honourable Forum directed the complainant to file a fresh complaint. Hence the C.O.P. No. 154/06 was dismissed by this Honourable Forum on 30.01.07. So this fresh complaint is filed before this Honourable Forum by the direction of this Honourable Forum.

    The Counter Statement filed by the Opposite parties are as follows:


    5. The complainant purchased the motorcycle "Unicorn" from 2nd opposite party on 26.11.04. The complaint is abusing the process of law by making complaints repetitively. As such he is estopped by his own act to file the present complaint. The complainant is exaggerating the issues that he has failed to prove at the appropriate stage and the very act of filing the same complaint for 2nd time amount to harassment of the opposite parties which is against the settled principles of law and justice. Defects were reported are of routine nature and rectified to the satisfaction of complainant and these are not manufacturing defects but normal defects arose mainly due to improper usage and negligent driving habits of the user. As such there exists no ground for filing the complaint and claiming any relief whatsoever.

    6. The complainant has distorted the facts and concealed material information to mislead this Forum. On 9.12.05 when the complainant approached workshop of 2nd opposite party after inspecting the vehicle, it was found that the engine was earlier opened and some engine work was got done at some unauthorized private mechanic workshop. The paste found in the engine was not recommended one and was of such inferior quality that it was meant for use in plumbing work.

    7. When this fact was conveyed to the complainant he started misbehaving and threatened to drag the opposite parties to Consumer Forum. The present complaint has been filed solely for the purpose of putting undue pressure on opposite parties and is an attempt to give a picture of genuineness to their otherwise unwarranted allegations pertaining to deficiency and defect in the vehicle. There is no manufacturing defect in the said vehicle. All the allegations of the complainant are totally vague, without any basis and denied vehemently. As and when brought to the workshop of opposite parties the vehicle was duly attended and delivered in a defect free and sound running condition. It is stated that the vehicle of the complainant had subject to negligent driving and also serviced/repaired at unauthorized private mechanic workshop.

    8. As per the terms of warranty, the complainant is not entitled to warranty at all. Despite failure on the part of complainant to comply with terms of warranty, his vehicle was attended under warranty to co-operative with the customer.

    The complainant however wanted to take undue advantage of the liberal attitude of the opposite parties and demanding for the benefits for which he is not entitled in any manner. The complaint has concealed the material facts and filed this complaint based on false facts. The complaint is liable to be dismissed on this ground alone. The present complaint is not maintainable under the Consumer Protection Act, 1986 in the interest of law and justice and to avoid multiplicity of complaints. The very act of filing complaint on similar grounds second time amounts to harassment of opposite parties and the complaint is abusing the process of law. The complaint therefore liable to be dismissed on this ground alone.

    9. The complainant and opposite parties have filed Proof Affidavit along with Ex.A1 to A8 was marked and Ex.B1 to B3 were marked on the side of the opposite parties.

    The point for consideration is

    Whether the opposite parties have committed deficiency in service? If so to what relief the complainant is entitled to?

    ISSUE 1

    10. The case of the complainant is that he purchased a black colour CBF 150 Model HMSI Honda, Unicorn bike from the 2nd opposite party on 26.11.04 which was manufactured by the 1st opposite party. The 1st opposite party has given the bike with manufacturing defects, the 2nd opposite party in turn sold the bike to 3rd opposite party. The 3rd opposite party sold the bike with manufacturing defects to the complainant. The first opposite party has given the bike with manufacturing defects the second opposite party in turn sold the bike to third opposite party. The first opposite party has given the bike with manufacturing defects the 2nd opposite party they in turn sold the bike to third opposite party.

    Third opposite party sold bike with manufacturing defects to the complainant. From the date of purchase the bike did not run smoothly and it gave many troubles and every occasion the 2nd and 3rd opposite parties simply made some adjustment without even replacing the defecting parts and redelivered the same. The 1st opposite party has given the bike with manufacturing defects the 2nd opposite party sold bike with manufacturing defects to the complainant.

    11. The case of the opposite parties is that the defects were reported are of routine nature and rectified to the satisfaction of complainant and these are not manufacturing defects but normal defects arose mainly due to improper usage and negligent driving habits of the user. The very act of filing complaint on similar grounds second time amounts to harassment of opposite parties and the complaint is abusing the process of law. The complaint therefore liable to be dismissed on this ground alone.

    12. The main allegation of the complainant is from the date of delivery, the vehicle did not run smoothly and there are manufacturing defects. The complainant has purchased the vehicle on 26.11.04 and as per complaint Para 8 only on 16.12.05 a fax message was sent to the 1st opposite party pointing out the major manufacturing defects of the bike such as disk break failure, broken seat tail piece, speedometer cable was cut off for three times break pedal clearance is too less, stand also hits the ground, when breaks are applied extra.

    But the complainant has not produced any document like job card to prove the above said contentions. But as per Ex.B2 job card dated 2.3.06 within two years from the date of purchase the vehicle has been used for 23,886 kms. By no stretch of imagination it can be presumed that a vehicle having manufacturing defect can give such an performance within such period of time.

    What is mean by manufacturing defects?

    13. A defect arises in the normal usage of vehicle and can be removed after its service / repair. A manufacturing defect on the other hand is a defect from the very beginning and cannot be removed even after repairing the vehicle.

    14. The defects reported in the vehicle were not in the nature of

    manufacturing defects but the defects arising during the usage of vehicle. The present case within two years the vehicle has been used for 23,886 kms as per Ex.B2. The complainant has used the vehicle to his satisfaction infact the vehicle has been used for nearly 23,886 kms. Ie 1000 km. per month. Within two years. These materials facts are surpassed by the complainant. In fact the complainant has already filed CC.154/08 which was dismissed as not pressed and the present case is filed. Hence the defects reported are of routine nature and rectified, these defects are not manufacturing defects as such there exist no cause of action. Hence the present complaint is liable to be dismissed.

    In the result, the complaint is dismissed. No Costs.

    The brief facts, as alleged, in the complaint are that the complainant Sh. Navdeep Katoch, had purchased a new Honda Unicorn Motorcycle bearing frame No.ME4KC091A68008071, Engine No.KC09E8008106, and model No.CBF150P, on 27.9.2006, for his day to day activity, against payment of Rs.54000/-, approximately, from the opposite party No.2, who is the duly authorized agent of the opposite party No.1. It is alleged that after few days, from the purchase of this Motor cycle, starting and engine problem had developed in this motor cycle. Upon this, the matter was reported to the opposite party No.2, who had assured him that since this defect in the motor cycle was minor, and it would be removed after it’s due repair.

    It is alleged that after few days of it’s repair, the engine problem in this motor cycle had again developed. The matter was again reported to the officials of the opposite party No.2. At this time, the complainant was asked to leave this motor cycle in the agency, for it’s repair, and he was told that he would be informed telephonically. After leaving the Motor Cycle in the agency, the complainant came back to his house. After one week, when the complainant did not get any information from the opposite partyNo.2, he had approached him, and he(complainant) was told by the opposite party No.2, that the defect in the Motor Cycle has been totally removed, by replacing it’s cylinder kit, cam shaft, and timing chain.

    It is alleged by the complainant that despite the repairs of the Motor Cycle, the engine problem had not ended, and he had again reported the matter to the opposite party No.2, and the Motor Cycle was again kept in the agency, for a period of more than 8 days, but nothing was done by the opposite party No.2, to remove the defect, and the complainant was only given a fake assurance all the times.


    After seeing no improvement in the aforesaid defective Motor-cycle, he(complainant)had again met the opposite partyNo.2, but he had started avoiding him by making one execuse or the other, but on being pressurized by him(complainant), the opposite party No.2, had asked him to leave the Motor Cycle in the agency, as the Engineers of the opposite party No.1, were coming to remove the defect in the Motor Cycle, and accordingly, he(complainant) had left the Motor Cycle in the agency of the opposite party No.2, on 25.7.08 with meter reading 27317 KMs.

    It is alleged that after few days, when the complainant had again visited the business premises of the opposite party No.2, getting the delivery of the Motor Cycle, he was informed by the opposite partyNo.2, that the defect in the Motor Cycle, was not so far removed, and he was further told that he would be informed shortly, after the removal of the defect in the Motor Cycle. Thereafter, after the period of 47 days, on 2.9.2008, the complainant was informed for taking the delivery of the Motor Cycle, and when he took the delivery, the meter reading in the Motor Cycle was 28112. So, it was clear that the Motor Cycle was used for a distance of 795 kilometers, during the time; it was lying with the opposite party No.2. It is also alleged by the complainant that he was also asked to pay certain amount of money, for the replacement of few parts of this Motor Cycle, at the time it’s delivery to him, and despite all these things, it was noticed after few days, that the defect in the Motor Cycle was not removed by the opposite parties.


    Thereafter, he had served a legal notice dated 5.9.08 upon the opposite parties, but no proper response was given by them. It is alleged that the complainant had availed all the services of the Motor Cycle from the authorized service station of the opposite party No.1, as per user manual, issued by the Company, but the defect in the Motor Cycle could not be removed by the Company, which clearly shows that a defective Motor Cycle was sold to him (complainant) by the opposite parties.

    The complainant has also contended that it was stipulated in the warranty Policy, that the “Company will replace or repair at their authorized workshops, free of charge, within a period 24 months from the date of sale or until the vehicle has been driven for 32,000 K.M. of run, whichever event occurs first, such part or parts thereof as may be found, on examination, to have manufacturing defect”. It is alleged that the Motor Cycle in question, up to the filing of this complaint, was sill under the warranty period, and it had not covered the distance of 32000 kilometers, and the opposite parties had failed to remove the defects in the Motor Cycle. So, there is clear cut deficiency in service, on the part of the opposite parties.


    It is alleged that this Motor Cycle had hardly remained with him, for a period of 16 months, and rest of the time, it had remained in the garage of the opposite party No.2, which had caused lot of inconvenience to him, due to un-usual behavior of the opposite parties. It is further alleged by the complainant that he has also suffered financial losses, mental harassment, and agony and physical torture. So, he has prayed that the opposite parties be directed either to replace the Motor Cycle, or to pay a sum of Rs.53,000/-, alongwith interest @ 18% per annum, with effect from 27.9.2006 till it,s payment. He has also claimed the compensation to the tune of Rs.50,000/-, for his mental agony, and harassment etc, and has also claimed a sum of Rs.10,000/-, as litigation charges, form the opposite parties.

    2. Both the opposite parties, were proceeded against exparte by this Forum, vide our order dated 4.12.2008.

    3. We have considered the arguments of Sh. Vinod Kumar, Adv. vice Sh. Sandeep Katoch, Adv., learned counsel for the complainant, and we have also carefully gone through the case file, facts and evidence on the record.

    4. Ex.CW-1, is the affidavit of the complainant Sh. Navdeep Kumar, in which he has verified the version of his complaint, on oath. Although, the complainant has also filed the photo copies of the Emission warranty contract, warranty registration card, job card, and copy of the legal notice dated 5.9.2008, sent on his behalf, to the opposite parties, original postal receipt, and photo copy of the warranty policy, but since the opposite parties have not bothered to come and contest this complaint, so the version of the complainant, and his evidence, remains un-rebutted on the file. We have no reason to dis-believe the version of the complainant and his affidavit, which is not contradicted by any other evidence on the file. We feel satisfied that both the opposite parties had sold a defective Motor Cycle to the complainant, and they had also failed to remove the technical defects, in the Motor Cycle, within the warranty period. So, therefore, we have no option, except to accept the contentions of the complainant.

    5. In view of the discussion made hereinabove, the complaint is partly allowed. The opposite parties are directed jointly and severally, to remove the defects of the Motor Cycle, free of costs, by taking it, from the residence of the complainant, within a period of one month from the date of receipt of the copy of this order, and to return it after removing the defects within further period of 20 days, failing which to pay a sum of Rs.5,000/-, for it’s repair, which the complainant may get repaired the defects of the Motor Cycle from some other workshop. We further feel satisfied, that the complainant has suffered mental agony, and harassment due to un-wanted act and conduct of the opposite parties, so we assess Rs.2000/-, as compensation for his mental agony and harassment, and we also assess litigation costs to the tune of Rs.1000/-, which will be paid opposite parties jointly and severally, within 30 days after the receipt of copy of this order. The copy of this order be sent to both the parties, free of costs, by registered posts and the file after it’s due completion be consigned to the record-room.

    It is alleged that after few days of it’s repair, the engine problem in this motor cycle had again developed. The matter was again reported to the officials of the opposite party No.2. At this time, the complainant was asked to leave this motor cycle in the agency, for it’s repair, and he was told that he would be informed telephonically. After leaving the Motor Cycle in the agency, the complainant came back to his house. After one week, when the complainant did not get any information from the opposite partyNo.2, he had approached him, and he(complainant) was told by the opposite party No.2, that the defect in the Motor Cycle has been totally removed, by replacing it’s cylinder kit, cam shaft, and timing chain.

    It is alleged by the complainant that despite the repairs of the Motor Cycle, the engine problem had not ended, and he had again reported the matter to the opposite party No.2, and the Motor Cycle was again kept in the agency, for a period of more than 8 days, but nothing was done by the opposite party No.2, to remove the defect, and the complainant was only given a fake assurance all the times.


    After seeing no improvement in the aforesaid defective Motor-cycle, he(complainant)had again met the opposite partyNo.2, but he had started avoiding him by making one execuse or the other, but on being pressurized by him(complainant), the opposite party No.2, had asked him to leave the Motor Cycle in the agency, as the Engineers of the opposite party No.1, were coming to remove the defect in the Motor Cycle, and accordingly, he(complainant) had left the Motor Cycle in the agency of the opposite party No.2, on 25.7.08 with meter reading 27317 KMs.

    It is alleged that after few days, when the complainant had again visited the business premises of the opposite party No.2, getting the delivery of the Motor Cycle, he was informed by the opposite partyNo.2, that the defect in the Motor Cycle, was not so far removed, and he was further told that he would be informed shortly, after the removal of the defect in the Motor Cycle. Thereafter, after the period of 47 days, on 2.9.2008, the complainant was informed for taking the delivery of the Motor Cycle, and when he took the delivery, the meter reading in the Motor Cycle was 28112. So, it was clear that the Motor Cycle was used for a distance of 795 kilometers, during the time; it was lying with the opposite party No.2. It is also alleged by the complainant that he was also asked to pay certain amount of money, for the replacement of few parts of this Motor Cycle, at the time it’s delivery to him, and despite all these things, it was noticed after few days, that the defect in the Motor Cycle was not removed by the opposite parties.


    Thereafter, he had served a legal notice dated 5.9.08 upon the opposite parties, but no proper response was given by them. It is alleged that the complainant had availed all the services of the Motor Cycle from the authorized service station of the opposite party No.1, as per user manual, issued by the Company, but the defect in the Motor Cycle could not be removed by the Company, which clearly shows that a defective Motor Cycle was sold to him (complainant) by the opposite parties.

    The complainant has also contended that it was stipulated in the warranty Policy, that the “Company will replace or repair at their authorized workshops, free of charge, within a period 24 months from the date of sale or until the vehicle has been driven for 32,000 K.M. of run, whichever event occurs first, such part or parts thereof as may be found, on examination, to have manufacturing defect”. It is alleged that the Motor Cycle in question, up to the filing of this complaint, was sill under the warranty period, and it had not covered the distance of 32000 kilometers, and the opposite parties had failed to remove the defects in the Motor Cycle. So, there is clear cut deficiency in service, on the part of the opposite parties. It is alleged that this Motor Cycle had hardly remained with him, for a period of 16 months, and rest of the time, it had remained in the garage of the opposite party No.2, which had caused lot of inconvenience to him, due to un-usual behavior of the opposite parties.


    It is further alleged by the complainant that he has also suffered financial losses, mental harassment, and agony and physical torture. So, he has prayed that the opposite parties be directed either to replace the Motor Cycle, or to pay a sum of Rs.53,000/-, alongwith interest @ 18% per annum, with effect from 27.9.2006 till it,s payment. He has also claimed the compensation to the tune of Rs.50,000/-, for his mental agony, and harassment etc, and has also claimed a sum of Rs.10,000/-, as litigation charges, form the opposite parties.

    2. Both the opposite parties, were proceeded against exparte by this Forum, vide our order dated 4.12.2008.

    3. We have considered the arguments of Sh. Vinod Kumar, Adv. vice Sh. Sandeep Katoch, Adv., learned counsel for the complainant, and we have also carefully gone through the case file, facts and evidence on the record.

    4. Ex.CW-1, is the affidavit of the complainant Sh. Navdeep Kumar, in which he has verified the version of his complaint, on oath. Although, the complainant has also filed the photo copies of the Emission warranty contract, warranty registration card, job card, and copy of the legal notice dated 5.9.2008, sent on his behalf, to the opposite parties, original postal receipt, and photo copy of the warranty policy, but since the opposite parties have not bothered to come and contest this complaint, so the version of the complainant, and his evidence, remains un-rebutted on the file.


    We have no reason to dis-believe the version of the complainant and his affidavit, which is not contradicted by any other evidence on the file. We feel satisfied that both the opposite parties had sold a defective Motor Cycle to the complainant, and they had also failed to remove the technical defects, in the Motor Cycle, within the warranty period. So, therefore, we have no option, except to accept the contentions of the complainant.

    5. In view of the discussion made hereinabove, the complaint is partly allowed. The opposite parties are directed jointly and severally, to remove the defects of the Motor Cycle, free of costs, by taking it, from the residence of the complainant, within a period of one month from the date of receipt of the copy of this order, and to return it after removing the defects within further period of 20 days, failing which to pay a sum of Rs.5,000/-, for it’s repair, which the complainant may get repaired the defects of the Motor Cycle from some other workshop.


    We further feel satisfied, that the complainant has suffered mental agony, and harassment due to un-wanted act and conduct of the opposite parties, so we assess Rs.2000/-, as compensation for his mental agony and harassment, and we also assess litigation costs to the tune of Rs.1000/-, which will be paid opposite parties jointly and severally, within 30 days after the receipt of copy of this order. The copy of this order be sent to both the parties, free of costs, by registered posts and the file after it’s due completion be consigned to the record-room.

    I am Raman Jadhav, I had purchased new Honda Stuner before 18th March 2010 from Sai Point Thane, They offered me 4 free bike servicing, But they are not doing that properly, getting problems while riding. While taking bike, honda offered me a 62.5kms mileage for 1 litre, but getting only 25-30 kms per litre, informed the same thing so many times, but still they are not taking this issue seriously.
    kindly solve this issue on priority.

    I have booked CB Unicorn on 13th July 2010. Amount of the same is fully paid through bank loan. I have paid money since one of the driver of the show room told to pay money and he will help to get it earlier.

    Till today i am waiting for the same. Bank has deducted II nd instalment of loan. I had already given complaint thrice to customer service in website.

    I am having a hard time with the MANSAROVAR Honda service center located in Velachery, Chennai. I had given my bike , Honda Unicorn (TN 09 AJ 4998) a month back and they claims that i had to change my silencer and trusting the brand , i gave a nod and they billed me Rs 6000/-. I was not that happy with that but was ok as they changed a silencer. 15 days later, i hear a noise within a bike and i rushed it to Honda service center. To my shock , they gave me an estimate of Rs 13000 including changing tyres and i was told i would get a bike by 16/June. I get a call back from them that they will charge me Rs 20,000/- and if not they will give the DISMANTLED BIKE and charge me Rs 1500/- for labour. They were not cooperative and i could sense that i am being cheated.

    The nightmate doesn't stop there. They promised that i will get my 23/June/2011. I get a feed back call from them on June 12th and upon calling them back, i was told twice on different occasions that i will get my bike on 14/June/2011. Now when i call them to ask what time can i go and take the bike, they tell me that it will another 25 days.

    I am leaving out of station and all the plans were dependent on this. This leaves me in very horrendous situation and believe me i know two friends of mine who encountered similar incidents from the same service center. I am helpless as the bike is dismantled and i cant take it away from them. Also, the charges seem to be very high. I am surprised that a good working Unicorn needs an investment of Rs 26000/- . I will be grateful if you can look into it and get it sorted.

    I purchased Honda stunner CBF bike from modern motors kota in July-2010 but after 1 month its having problem of automatic stoppage in rainy season. at the time of servicing i told that its having automatic stoppage problem in rainy season.then they serviced the bike and told me that it will not happen again.but the problem still persist i cant take my bike in kota daily from gadepan.after rainy season bike running smoothly.
    Tomorrow i went to kota from gadepan but i reach there in 2 hour because bike again having automatic stoppage problem in rain.i start bike its go around 50 meter and again its stop its happen at least 50 times in 40KM running.3-times i save myself from accident.i went to modern motors and told the problem.he check and say there is not any problem in bike.i told that its happening in rainy but he check and say now it will not stop. i take my bike after 1 hour rain again come and bike again having same problem.i am getting sick due to cold weather and rain.i am totally frustrated with bike.now i want that please get my bike back because my health is more important that riding the bike.you can't beleive i save myself 5 times tommorrow and 1 accident occur due to stoppage of my bike.i am in depression and fear comes in my mind now.i dont know again i shall ride my bike.
    i am taking this matter in consumor court because i want 2 know that life is more important or money is more important for Honda.

    [FONT=arial, helvetica, sans-serif]On 29th July 2011 I paid Apple honda a booking amount of 1000Rs for Black Dio with acessiories. they promised me to phone call in 3months when vehicle arrives. on 29th Sept i called them and they (apple honda) asked me to pay rest amount and take delivery in 7 to 15 days. so on 3rd Oct after a weeks wait they said please wait till evening (3rd oct 2011) as we are fitting accesiories to your vehicle - we will call you for delivery. After wait for four day i approched today apple honda (7th oct 2011) and they replied me that vehicle is ready but have Exide battery problem so if you want to take vehicle now, then take it but with battery problem. My point is since 3rd oct they promised me to deliver Dio and I didn't got any phone call from apple honda. As it was deshara i am dam sure vehicles (Dio) were deliberatly given to relatives of apple honda. With many grevience point i would like to discuss more with Honda motor cycle manager if allowed to talk.

    Finally Ankur Gandhi - Director apple honda, Vadodara with wordly fight asked me leave office and prove us that we have give vehicle to customers not according to booking order. He also said me that we (director of branch) is given right to sell 10 % of vehicle to relatives/their own choice. This makes corruption, as they can stock those vehicle and sell it to their price in desperate world of customers. Why Directors of branch is given right to sell 10% of vehicle to customer of their own choice?

    This is Mahinder I am using Hero Honda Glamour, I buy this bike on January 2011. now my bike condition is bad the showroom people are not taking care in the servicing many times i reported to them but they are not listening my words. when i given for servicing just they are doing water wash only they are not looking in the internal problems. Every time they are saying that bike is ok. I am facing the problem with my bike. Pleases take action on show room located at Ramanthapur, Hyderabad.

    The scooter is giving us lots of problem like low average , automatic stop during running ,noise in engine rings and kick start from the very bigning of the purchase, it gives us a bad impression on Honda. So i have contacted service centre but they are telling me i have to pay Rs.4000/- for the painting & my bike is not 1 year old. How should i go further to get it painted

    The kind of service i am getting from Honda motors located in Kollam, Kerala is truly speaking the worst & the most pathetic one. I am having a Honda Unicorn dazzler with proper insurance,my bike had an accident 3 months back(09 Sep.2011), i gave it for repair at Vahini motors located in Kollam, Kerala, ever since i am at dismay. Every time i call them they come up with a different excuse. On Nov.10th i made a call, they said all the parts are fixed except for two which will be done in a couple of days & will call me back when its done, though they didn't, so again i made a call on Nov.15th this time their excuse was they had assembled all parts except the silencer which will be done again with in few days.Their recent excuse is bout the rear mud guard, i don't know how come a company like Honda have a shortage of parts, that too for the latest designs like Honda unicorn dazzler.
    Honda always resembles perfection & elegance, but truly speaking the kind of service endured in India by Honda motors is really causing a bad impact specially to their name. I don't know why aren't they so keen bout the services when their product is so well defined.

    • On my 2nd service,service engineer had informed me that engine is not working properly and problem with cylinder kit. I had asked to replace the same. But at that time it was informed that part is not available. Even after regular follow up with service centre(Auto tech race honda)when I not got any reply, I Iodged complaint online(customercare@2wheelersindia.com) on 19/10/2011 and given reminder on 02/11/2011 but no action has been taken. After 20 days of 2nd reminder I got a call from Honda that cylinder kit is available with service centre and you may replace the same.Immediately I visited the service centre but whole cylinder kit has not been replaced, only some parts replaced and I was charged approx. Rs.1000.
    • Now again noise is coming out from engine resuting I am unable to ride bike.
    • Sir, I am in a marketting company as a sales officer and bike is as our life line.
    • It gives us a bad impression on Honda. HONDA is a reputated company we can not imagine such a bad product from the company like Honda.

    [h=6]I owned honda unicorn 150cc bike black color last year apr 2011 at anna nagar JSP Honda chennai, tamil nadu, I booked my bike end of the jan 2011, i was wait for my bike nearly 3 months, second month they made a call and informed that red color unicorn is available now can you take it and if you wait for black it will take one more month, i said i will wait i need only black color, finally i got my black color bike, few days before i had a scratch on petrol tank in side it was red color painted and i identified it was a red color bike because back side shield also red color they painted black color and given to me as black color even now i had doubt about them they are doing assemble the bike with the duplicate spare parts. They were fooled me and they are cheated my money also they are fooled government they registered my bike as black at RTO, Kindly any one help me to approach in legal or to take necessary action against them.     1.My two wheeler(Honda Unicorn) bearing registration number :- AP28BS6418 , with Engine Number :- KC09E6245994, Purchased in RAAM honda Show Room , Tadbund, Secunderabad, A. P .
    Its being 4 months we bought the bike , Expected a lot from My bike , but I am now more frustrated since my bike lies in the same condition after changing the bike tyers

    There is a lot of shacking when I drive the bike on the avg speed of 60 KMPH , In spite they have recommended me to change the bike tyers , I have changed both front & back tyers with the Mac Wheels even.But still There is a big trouble when I drive ..


    Try to resolve the Problem as soon as possible .

    Sir I am Buying A Brand new honda shine motorcycle Amounted Rs.61500 on 7/09/2012 .Dealer reprentative told me you have pay 13500 as down payment and rest of amount is processed through loan from hdfc bank in which you have a salary a/c and same process was done by me but when the loan was approved from the bank then i am socked bank was aproved the loan amount is 54528 and after deducting his charges dealer received the amount from bank is 53283 then i am calculating that which is 13500 as downpayment +53283 as loan approved by bank=66783 pls do something and help me to retun my access amount 5283 .The representative of showroom is not listening my complaint and nothing doing against my compalint every time same verdict is giving to showroom i.e. come tommorrow or after one week Everytime when i am going to showroom representative tell me, the concerned person is on leave me, by representatives

    I have given the whole amount of activa on 18th of october then Zaveri honda kurla people promised me that they will deliver the activa on 19th but when i approached for the same they said that they cannot deliver it and it will 15 take more days because of this I have made loss of 2k Rs. not only that to make the full payment i have taken 30000 rs loan from my friend for which i have to pay 3% interest every month.. KIndly tell what i am supposed to do... other then launching a complaint is there any other option....

    I had purchase CBR150 R on 12/11/2012, and now this dealer Baba honda, kharagpur and west regional zone office (honda) are troubling me for permanent registration, though i had submitted adress proof ( bank pass book and rental agreement). i had paid all the money. They said they will not do the permanent registration. If not so take your bike back and give me my money.

    i buy honda shine on date 15dec.2012.after riding 10km,there is some noise in backtyre.and the tyre was jammed.Go to the dealer emrald honda(shahibaug.ahmedabad)manager said that check the problem.but till today(23th dec.)i did not get any responce.

    Delivery of my new Bajaj Pulsar 220 was on 11/02/2014. Since then the handle gets jammed and unable to take swift turns, which means if entire turn is not taken then there is a chance of an accident. I have saved myself on couple of occasions this way. My first servicing was done in Bajaj Vishrantwadi service center whom I brought to their notice on this issue but after servicing as I experienced same issue I then had to turn to another service center at Bajaj Wakdewadi. But after servicing this was again the issue later yet I didnt turn to any local mechanic to do up my problem and rested my faith on Bajaj but, now again I have faced handle turning issue and so I need to complaint and this time it is matter of life and death. I urge you to take strict action on the same. My Regtn no. of Bajaj Pulsar is MH-14-EF-9732.

    I have to lodge the complaint against mahindra two wheelers as I purchased a mahindra centuro bike at Rs.54000 on aug 2013.But from first day to today my bike is giving average of only 40km/lit as the compony specifies that the bike has average of 85.4 kmpl milage. Please take a quivk action on the complaint as I can't afford such a big difference in average.
