ORDER
The complainant has prayed for the following directions to the opposite parties:-

[FONT=&quot](i)[/FONT][FONT=&quot]To direct the opposite parties to comply with the deficiency in service and issue a settlement of all dues letter to the complainant,[/FONT]

[FONT=&quot](ii) To direct the opposite parties to refund the entire amount taken from his saving bank account bearing No.00761000048331, with accrued interest,[/FONT]

[FONT=&quot](iii) To hold the opposite parties deficient in their service and for using unfair trade practice direct the opposite parties to pay to the complainant in the form of damages an amount of Rs.2,00,000/- towards the mental trauma, physical strain and immense stress caused by the opposite parties,[/FONT]

[FONT=&quot](iv) To pass any such order of relief that this Honorable Forum may seem fit to grant in the circumstances of the case,[/FONT]

[FONT=&quot](v) To award costs of this dispute recoverable from the opposite parties.[/FONT]

The case of the complainant is as under:-
He is working for a private limited Company and residing at Bangalore. He availed credit card No. 4050 2820 0026 7851 from the opposite parties and the credit card was issued on his account No.00761000048331 with credit limit over lakh of rupees. He had been using the credit card for purchases and repaying the amount within the prescribed period till the year 2005. He had taken insurance policy and the premium in that regard was payable quarterly. He availed smart pay facility from the opposite party for payment of the insurance premium of Rs.2,500/- per quarter and he had 45 days time to make payment of the said amount to the opposite parties. The opposite parties were to make payment of Rs.2,500/- towards quarterly premium, but from the statement dated: 23.12.2005 he noticed that instead of Rs.2,500/- the opposite parties had paid Rs.5,033/- towards premium. Immediately he approached the opposite parties on various dates and informed that they had made payment of Rs.2,500/- in excess towards insurance premium and requested to sort out the issue.

He made payment of Rs.3,013/- through cheque No.311895 being the remaining amount after deducting the additional amount paid by the opposite parties. He also requested the opposite parties to stop smart pay facility and as per the letter dated: 21.01.2006 the opposite party cancelled the said facility with effect from 18.11.2006. Since then he has been in constant touch with opposite parties seeking clarifications about the additional payment made from his account. But the opposite parties evaded the quires and have kept on charging interest and late fee on the said amount. Though he has paid the entire outstanding dues he was getting bills of payment of dues which were actually not due and payable by him. He addressed several e-mails to the opposite parties. After receiving the entire outstanding amounts the opposite parties never issued any letter of settlement. Since he was repeatedly calling and sending e-mails to the opposite parties one official called him over phone and requested to approach opposite party No.1 and to show the receipts regarding payments and to collect a settlement letter. When he approached opposite party No.1, he was made to wait for long hours and finally one of the customer care people informed that they would get back after they have the information, but so far no reply is given. The opposite parties had in fact freezed and were threatening to set-off the funds available in his SB account. The opposite parties issued letter dated: 04.11.2008 calling upon him to remit the alleged outstanding amount of Rs.21,866.77 paise within seven days failing which, the amount would be debited to his SB account as per the ‘cross default’ clause of the card member agreement.

Thereupon he issued a legal notice dated: 12.11.2008 calling upon the opposite party not to forfeit the outstanding in the savings account. When he tried to contact the opposite parties in respect of the said letter one Gowda and another threatened him. Till date he has been receiving the letters, statements and SMS on his mobile stating that he has not paid the dues. He fails to understand that in spite of paying the entire amount his account shows an outstanding. The opposite parties have not only committed mistake in calculating the outstanding, but have forfeited the entire amount available in his savings account and have thus subjected him to lot of mental trauma and physical strain. Hence the complaint.

2. In the version the contention of the opposite parties is as under:-

Earlier the complainant had obtained a silver credit card with credit limit of Rs.65,000/- in the year 2005. Thereafter the credit card was upgraded to Visa- Platinum – Plus – Credit - Card with credit limit of Rs.1,55,000/- in the year 2007. The complainant had taken ‘Smart Pay Facility’ on the credit card to pay the insurance premium as and when demanded by the Insurance Company. Accordingly the amount was paid as per the demand made by the Insurance Company. They have no knowledge about the terms of the policy like the amount of premium and its period. They are only concerned with the payment of the respective demand made by the Insurance Company and they have promptly paid the amount towards premium.

They have no knowledge that the complainant has to pay Rs.2,500/- towards quarterly premium. The complainant was required to implead the Insurance Company also as a party to the proceedings. As per the request of the complainant the Smart Pay Facility was cancelled with effect from 18.11.2006. From August-2008 the complainant is not making any payment though there is sufficient balance in his credit card account. As per the statement dated: 23.10.2008 the complainant is due Rs.21,866.77 paise and the complainant has not come forward to pay the said amount in spite of repeated request and reminders and has filed the present complaint without proper reasons. Since the complainant fails to make payment of the dues in spite of several requests and reminders they exercised right of “General Lien” on the amount available in the SB account of the complainant to an extent of Rs.18,140.43 paise with effect from 04.11.2008 and the same has been intimated to the complainant through notice dated: 04.11.2008 by which the complainant was called upon to pay Rs.21,866.77 paise. They have every right of exercising ‘General Lien’ as per the card member agreement.

Therefore there is no illegality on the part of the opposite parties. The complainant is liable to pay the utilized amount by using the credit card. The complainant has not approached this Forum with clean hands and therefore not entitled to the relief prayed for.

3. In support of the respective contentions, both the parties have filed affidavits, have produced documents and have filed written arguments.

4. The points for consideration are:-
(1) Whether the complainant has proved deficiency in service on the part of the opposite parties?

(2) Whether the complainant entitled to the relief prayed for in the complaint?

5. Our findings on the above points are in the Negative for the following:-
REASONS
POINT Nos. 1 & 2:-
6. The complaint is filed on 18.12.2008 alleging that, as per the statement dated: 23.12.2005 the opposite party has paid Rs.2,500/- in excess towards the insurance premium under the Smart Pay Facility. If the complainant noticed excess payment made by the opposite party towards the insurance premium in the monthly statement dated: 23.12.2005, the cause of action to claim refund of the excess payment made accrued to the complainant on 23.12.2005. As such, the complainant was required to file the complaint seeking relief in respect of the excess payment within two years from 23.12.2005 as provided in Section 24 of the Consumer Protection Act. The complaint filed on 18.12.2008 is beyond the period of two years and as such, the claim of the complainant in respect of excess payment of Rs.2,500/- towards insurance premium is barred by limitation. The complainant has not even filed application for condonation of delay as required Under Section 24(A) of the Consumer Protection Act. Therefore this claim being barred by limitation the complainant is not entitled to that relief. However from the prayers made by the complainant in the prayer column it is evident that he has not prayed for any relief in respect of excess payment of Rs.2500/- made by the opposite party towards insurance premium. Except the details of the excess payment of Rs.2,500/- towards premium the other averments in the complaint are very vague. The complainant claims that he had paid the entire amount due and in spite of it, the opposite party sent the letter dated: 04.11.2008 demanding Rs.21,866.77 paise. But the date on which the entire amount due was cleared, and what is the amount paid towards full clearance of the dues is not disclosed. It appears in spite of repeated demands and requests the complainant failed to make payment of Rs.21,866.77 paise and therefore exercising the right of ‘General Lien’ the opposite party debited Rs.18,140.43 paise to his SB account as stated in Para-8 of the version. As per the terms of the Card Member Agreement which is extracted in Para-8 of the version the opposite party is entitled to exercise such Right of Lien on the amount available in the SB account of the customer who fails to clear the dues in his credit card account. If that is so, the act of the opposite party in debiting the amount available in the SB account of the complainant towards the amount due in the credit card account will not amount to deficiency in service. As such, we hold that, the complainant is not entitled to the relief prayed for. In the result, we pass the following:-
ORDER
7. The complaint is dismissed. No order as to costs.

8. Send a copy of this order to both the parties free of costs immediately.

9. Pronounced in the Open Forum on this 18th DAY OF MARCH 2009.

    This case came up for final hearing before us on 25.03.2009 in the presence of Sri. Ch. Baswaraj, Advocate for complainant and the opposite parties remained absent, upon hearing the arguments of complainant’s advocate, on perusing the record and having stood over for consideration till this day, this forum delivered the following.
    O R D E R

    The complaint is filed Under Section 12 of Consumer Protection Act, 1986 to direct opposite parties to pay insurance amount of Rs. 3,00,000/- with interest at 12% p.a. from the date of complaint and further to pay Rs.1,50,000/- as compensation and also to pay Rs.5,000/- towards costs of the complaint.

    The contents of complaint in brief are as follows:-

    1). The complainants belong to Morgi village of Manoor Mandal, Medak District. Their son Yekhalli Shiv Kumar worked as area manager in Dr. Reddy Laboratories at Puna Branch. He was holding HDFC bank International gold card membership bearing No. 5176 5210 0545 4600 which is valid from 08/07 to 09/10 with Puna branch. He died in road accident on 3.05.2008 near Dharwad district of Karnataka State for which Garg Police Station registered a case in crime No. 66/2008 U/s 279, 338 and 304A IPC. Opposite party No. 1 issued a booklet of international gold card covering insurance, where in it is stated that if the member of international gold card of HDFC bank dies in road accident the nominees of the card holders are entitled to get Rs.3,00,000/- as compensation. After the death of the card holder Yekhalli Shiv Kumar, the complainants approached opposite parties No. 1 and 2 and their branches situated at Puna, Bidar, Sangareddy and Hyderabad and requested for payment of compensation amount of Rs. 3,00,000/-, as their son died in motor accident while holding the international gold card of their bank. All of them refused to pay. There upon the complainants verified the booklet issued by the opposite parties and came to know from page 32 that there was a tie up agreement between the opposite party No. 1 and insurance company. Immediately the complainants got a legal notice dt.18.07.2008 issued to opposite party No. 1 to known the mane of the insurance company and to further know the particulars of the policy for making it a party to this proceedings. Along with the notice, copies of FIR, gold card and booklet were sent for perusal. Opposite party No. 1 received the notice but there has been neither compliance nor a reply. The attitude of the opposite parties No. 1 and 2 amounts to deficiency in service. As the branch office of opposite party No. 1 is located in Sangareddy, which is opposite party No. 2, this forum has jurisdiction to entertain the complaint. As such opposite parties No. 1 and 2 are jointly and severally liable to pay the amounts to the complainant as claimed in the complainant. Hence the complaint.


    2) Notice was sent to opposite party No. 1 through registered post. It is deemed that opposite party No. 1 received notice. Opposite party No. 2 received notice. But they have not chosen to participate in the proceedings. Evidence affidavit of first complainant is filed on his behalf and on behalf of his wife, the second complainant to prove the contents of the complaint. Exs. A1 to A7 documents are marked on behalf of the complainants. No written arguments are filed for the complainants, however oral arguments are advanced. Perused the record.

    3). The point for consideration whether the complainants proved deficiency in service on the part of opposite party and that they are entitled for the various amounts claimed in the complaint?

    Point:
    4). The complainants’ case is that their son by name Shiv Kumar while working as area manager in Dr. Reddy Laboratories at Puna has taken international gold card membership from HDFC bank at Puna which is valid from August/2007 to Septermber/2010 but unfortunately died in a road accident on 3.05.2008 in Dharwad district in Karnataka State and in that connection Garg Police registered a case against the driver of Indica car bearing No. MH 14 BC 2546 by name Anand Salke. The son of complainants Mr. Shiv Kumar who was holding the HDFC international gold card died on the spot while traveling in that car, along with others-(Ex.A3) The complainants say that when they claimed for the assured amount from the opposite parties and their branches, at Puna, Bidar and Hyderabad but they refused to pay the amount.

    5). The opposite parties have not chosen to participate in the proceedings. At page 8 of the booklet which is marked as Ex.A2 it is clearly mentioned that for death in a road accident the nominated next of kin of the card holder will receive a compensation of Rs. 3,00,000/-. At page 32 of the same booklet it is mentioned under the head Personal Accident Policy” as “All Primary Card members of the Bank are covered for death due to road/rail/air accident”. It is also mentioned under the same head at page 32 of Ex. A2 as “For HDFC Bank Gold International Card, the cover is Rs. 3 lacs for death due to road/rail accident and Rs.25 lacs for death due to air accident”.

    6) The complainants have not produced any document to show that they are nominated by their son, the card holder Mr. Shiv Kumar, to receive the amount of Rs. 3,00,000/- in the event of his death in a road accident. Further the complainants have not stated whether their son Mr. Shiv Kumar was married or single, if married whether he had wife and children to receive the amount. On a reading of the complaint and the evidence affidavit of the first complainant there is

    no whisper any where that Mr. Shiv Kumar was married and he was having wife and children at the time of his death, to share the amount. As the complainants stated that they are nominees to receive the amount, even though there is no proof to show that they are nominees, as the opposite parties have not chosen to contest the matter, it is deemed that the version of the complainants that they are nominees and that they are entitled to receive the amount is not disputed by the opposite parties.

    7) The complainants marked the international gold card of HDFC bank of their son as Ex.A1. Certified copy of FIR in Karnataka language and its English translation are marked as Ex.A3. Ex.A4 is the office copy of the lawyer notice issued on behalf of the complainants to opposite party No. 1. Ex. A5 is postal acknowledgement in evidence of receipt of Ex. A4 notice by opposite party No. 1. Ex.A6 is postal registration receipt under which Ex. A4 notice was sent. At the time of arguments the learned counsel for the complainants referred to Ex. A7, which is “Sakshi” a Telugu daily news paper, where in according to him a news item is published that in a similar case Hon’ble State Commission of Andhra Pradesh awarded insurance amount and costs. Ex.A7 does not contain case number in which the Hon’ble State Commission rendered the said decision. Even otherwise a news item cannot be taken as evidence to reply upon Ex. A7, therefore it has no evidentiary value.

    8) It is not in dispute that the complainants’ son Mr. Shiv Kumar had taken international gold card from HDFC bank at Puna. It is stated by the counsel for the complainants that its head office is at Chennai which is opposite party No. 1. Opposite party No. 1 received lawyer notice. Notice was sent in this case by this forum through registered post. Opposite party No. 2 has received notice through local tappal. The complainant is entitled to file the complaint in this forum, as branch office of HDFC bank (which is opposite party No. 2) is located in Sangareddy which confers jurisdictions U/s 11(2) of the Consumer Protection Act, 1986, In view of the discussion supra it is held that the complainants are entitled to Rs. 3,00,000/- towards insurance and to compensation of Rs. 10,000/- and also further entitled to Rs. 2,000/- towards costs. As opposite party No. 1 failed to furnish the name and other particulars of the insurance company with which it has tie up, opposite parties No. 1 and 2 are jointly and severally liable to pay the above amounts to the complainants. The opposite parties No. 1 and 2 may proceed against the insurance company with which it has tie up, to recover the amount, if they are entitled and advised so. The point is answered accordingly in favour of the complainants.

    9) In the result the complaint is allowed directing the opposite parties No. 1 and 2 to pay to the complainants the Rs. 3,00,000/- payable under the international gold card with interest at 9% p.a. from the date of complaint till payment as requested in the complaint and to pay Rs.10,000/- towards compensation and Rs.2,000/- towards costs within one month from the date of this order. Their liability is joint and several. The complainants and directed to file legal heir certificate before filing cheque petition, to show that they are the only legal heirs.

    Sir,
    I am "Ravi Bhatnagar" S/O Y.K. Bhatnagar. I am working with "Progressive Infotech Pvt Ltd" in noida as a "Network Engineer". My office employee id is 1687.
    I own a salary account (acc no: 00881540041509) of HDFC bank on the behalf of my company. My HDFC bank customer id is 23893371.
    HDFC long back (7-8 months back,even before that) issued me a credit card(card no as they mentioned: 5176521007317771) on the behalf of my saving/salary account of hdfc bank on the mailing address of my office(mailing address: Progressive Infotech Pvt Ltd, c-161, Hosery Complex, Phase-ii, Noida-201301) but i never received that credit card & I had almost forgot about that card thing.
    Now after 7-8 months, I got a memo on 07/09/09 from HDFC saying that your card (which I did not receive ever) is now suspended as it is having dues of 2642.08 rs. HDFC Bank also said that they have included my name in the "DEFAULTER LIST" and take action against me.
    On the basis of those dues, HDFC bank has upheld my saving account on 14/09/09, having closing balance of 7089.18 rs without any prior information. I contacted HDFC bank but they are saying that "we cannot do anything to it as this is the matter of HDFC Credit Card Division". When contacted HDFC Credit Card Division, they told me that there is a insurance policy of "BAJAJ ALIENZ" applied on the credit card whose premium converted into the unpaid credit card amount.
    Now I really don't understand that when I never received/used the above mentioned credit card, why I am asked to pay the dues over that card.
    I mailed HDFC bank so many times and tried to make them convince that I never received and used that card but they didn't show any interest. I even warned them that "if you don't take me seriously, I will take legal actions against you"; but they didn't give me any satisfactory answer even I was never told that what is going on with my HDFC saving/salary account & when it will be unhold. They just said that our investigation is in process and we will intimate you but I hardly contacted by them for giving any information.
    Now at last after getting frustrate and depress, I am challenging HDFC bank for this irresponsible activity. As being the customer of HDFC bank and an "Indian National", I demand HDFC bank to either unhold my saving/salary account with all the money back(with all the interest) or give appropriate proof that I have ever received/used that credit card.
    I do request you to take appropriate actions against HDFC bank as because of this entire thing, I have mentally suffered a lot.
    I also expect the "Court Of Law" to force HDFC bank to withdraw my name back from the "DEFAULTER LIST" as it really spoiling my reputation and hurting my self-respect. I hope that being the helping body for the consumers, you will review the entire episode and take the appropriate actions against the bank.

    I HAVE NEVER USE MY HSBC CREdit card . it just pack like when we first time received.
    they had make charge 6546 rs for any policy. i have never take any policy from credit card.
    my card is pack then how is this possible they make charge .
    i have already discussed with jatin arora who manager of recovery dept.he was telling give card no and detial .but still my charge is not reverse.From 6 months continue i contact HSBC noida branch but they are not giving any response.
    Kindly help me for this trouble.

    they had make charge 6546 rs for any policy. i have never take any policy from credit card.
    my card is pack then how is this possible they make charge .
    i have already discussed with jatin arora who manager of recovery dept.he was telling give card no and detial .but still my charge is not reverse.From 6 months continue i contact HSBC noida branch but they are not giving any response.MY CREDITCARD NO 4384599980366669

    I wanted to write a detail mail to you on my settlement issue.

    I had a word with one of your customer care executive (name Himangi)on 22nd of Sept'09.On that day my outstanding amount of credit card settled in 25000/- and I have been instructed to pay this amount in three parts.9000/8000/8000 rs as well as given a reference no by her(SR 119572279).

    Rs 9000 to be paid as a 1st installment and within 10 days from 22nd Sept,Rs 8000 to be paid as a 2nd installment and within 25 days of 1 st installment deposit date and last 8000 to be paid as a 3rd and final installment within 25 days of 2nd installment deposit date.

    Also after paying first installment one of your executive will come with the settlement letter and collect the PDC of balance two installment.

    Now I paid 10000 towards my credit card account on 23rd Sept and to confirm this to in your bank i called up your customer care and for my surprise he told me there is no such settlement.

    Now I am in a fix what to do.I immediately need my settlement letter to pay the balance amount on time with the above said detail regarding my payment.

    Hi,

    My name is Neelam sing, i hold a salary account with HDFC bank. HDFC has holded my salary for this month because of some Credit card dues on me. Credit card number is - 517635801073037. As per bank I have not made any payments on this card. The card had a limit for 12000/- only. Now credit card department is informaing me that the total amount due on me is 55000/- including all the intreset. I am not sure why i have been charged so much, despite of the fact i never received any statement on the card. Bank has my permanent address and my permanent telephone number. No one contacted me regarding the payment. I fact i contacted Bank back till 2007 which was useless where the CS was not able to provide me any detalis. I always contacted bank so that I can pay the amount i used. I am using HDFC account since for last 4 years. They never holded my money before that, if theywanted to really take the amount, why no one deducted that amount earlier rather then waiting for 3 years when bank have charged me the intreset amount which is very huge. when i recah out to them they do not have answer to this.

    Hi,

    My HDFC Bank credit card was misused during an online transaction in February 2009 - amounting to around 4000/-. I blocked the card and asked for a re-issue. I also wrote a letter to the bank stating the specific transactions that were a result of unauthorized usage and requested them to not hold those transactions against me.

    Till date I haven't heard back from the bank nor have I received my credit card. Today I suddenly get a courier mail from th legal department of the bank stating that since I had not paid the pending amount of 8000/- they are blocking a similar amount from my savings account !

    I find it strange that all through the ten months they didn't feel it necessary to communicate with me and neither did their customer care people give me a proper response as to why I hadn't received my card or why I hadn't received any response from the bank regarding my letter and now suddenly they decide to block 8000/- !

    Please can you suggest any way out of this. I would be very grateful!

    Hi,

    My name is Sujata.im holding HDFC savings account .no - 00101050065078. and i had already setteled my credit card on 07/07/2009 and had got the settlement letter and reciept..but in 08/08/2009 i got a notice from HDFC bank they are holding all my savings bank amount and will transfer the fund toward credit card on 23/08/2004 as there are some due on the credit card.
    after contacting the credit card division they assured they will release the fund but till now they didnt release and the fund has been transfered to credit card..again i went to credit card division and they said they will raise a compalint (i had submiited all the docs.) and i will get an update within 7 working days and i too wrote a mail to hdfc bank customer service..they generated a request bearing no - HBL=008-154-635..
    its been 3 days past but i didnt get any update/call from anyone and when i tried reaching customer care on 66003333..i never get a chance to talk to an executive..now how do i know the status of the request..its been a long time i have been struggling to resolve this issue..i have lost all my peace and trust on those guys..its really embarrasing and hard to beleive being such an leading bank if they harass their customers, whom we will trust then??

    Please note that I am a customer of HDFC bank and hold a corporate salary a/c with you- -My name is Mr. Saptarsi Halder-

    I also have a credit card with your bank- My sb a/c no is-01051140022619 and my credit card no is-5289451001089818

    To my surprise, I was sent a legal notice from your bank dated 05th of October2009 and received by me few days back, accusing me of not paying off an outstanding amt of Rs16964.35 against a credit card that is name of Saptarsi Halder only but the card does not belong to me – The card no written on the legal notice was of no-4346772007581837 belonging to one Saptarsi Halder, though I am not that person against whom the notice has been sent

    I want to highlight the following major issues

    1) Is there any crime to have a name that incidentally may tally with a defaulter of any credit card and in the process get harassed by the bank ?

    2) Even if the customer to whom the legal notice has been sent erroneously repeatedly calls up phony banking and branch for support gets rude behavior and anger at being pointed out the mistake by the bank.
    3) I have a credit card the no of which is totally different from defaulter’s credit card no, then why did the bank not check the same before shooting a legal notice to a customer who also holds a corporate salary a/c? - Is this my mistake to have a name similar to that of a person who incidentally is a defaulter with your bank?

    Dear Sir,

    I had an HDBC credit card and I never used that card. HDBC bank had started some bajaj allianz policy without my confirmation. Later I cancelled it. But they told that I need to pay a processing charge of around Rs.1000/-. I had told them that I am not going to pay the processing charge as the policy was started without my confirmation. This had happened around 8 months back. But still they are calling monthly once or twice asking for the processing charge. They are telling that now the processing charge will be around Rs. 2900/- because of interest.

    Please let me know how to avoid this.

    Hdfc bank has cheated with me they didnt deliverd any gold card because i have already a titanium card and they never sent me any gold card 5575 and even they never sent me any bill but now they are saying you have outstanding 91000.00 rs i have sent so many mails to md mr. Aditya puri but there is no positive reply and they put my name in (sibil) and they blocked my saving classic account also and when i am calling to hdfc cust supp no one giving me positive reply since may 2009 i have sent arround 30 e-mails 10 courier 200 calls and arround 5 faxes i have all proof but they are not replying me they are saying they deliver card to my sister ashti and i have already proof to bank she is 13 years old how can you deliverd a credit card to minor and she is saying she didnt rcvd any card. But they are not replying me please take an immidate action

    My case is a funny case . I am not a customer for hdfc credit card . My mobile number is wrongly registered in their records 9845524515 .I have been receiving calls in the name of Nandakumar for the credit card payment from the last 10 months .I have replied politely and informed their staff and they are calling and troubling me. When a person gets a wrong call and messages for 10 months what he has to do?

    In spite of saying lot of times that i am not Nandakumar and they are speaking to a wrong person Raju. once i spoke to their manager john once he had advised that the number will be deleted from their records. I have called up customer care lot of times unfortunate they were not in a position to give reference number for the call.
    I had visited HDFC bank office near jayanagar 9 block last month they could not help me out of this.
    Last option I have thought is to file a case against HDFC and claim compensation.the amount of pain and tension .I have undergone a thyroid surgery recently .
    i will be happiest person to file this case.

    Dear sir,

    my credit card no is 5415382314244500, issued around oct'05. Till today
    i have
    made no purchase by your credit card. But from jan'o6 onwards regularly
    i am
    being disturbed over phone by abn amro staff that i have purchased
    something worth rs.8047/-
    and i have to pay the bill but till date no statement came to me and
    the outstanding
    amount is rs. 11689/-.

    After repeated emails they sent me one statement where only the
    outstanding amount is written , no purchase particulars are not
    mentioned-which clears that it is a fake or framed bill.

    I am really surprised by seeing their attitude for charging me for a
    fake expense and
    moreover putting interest on it.

    Two years back (april'06)their kolkata branch official mr rakesh biswas
    rang me up and said that the
    rs.8047/- was mistakenly posted on my card and after interest
    calculation the amount
    became rs.11000/- odd.so he requested me to pay rs.100/- for closing of
    the account
    and settlement, i paid rs. 100/- on 24.04.06 by cash (receipt copy
    7039).but from 18.05.06
    onwards i am getting phone calls from your kolkata office for payment
    by mr sujit and
    mr rathi.

    Then i rang up mr biswas, he told me that they may not be knowing the
    real reason and my
    account has not been closed as head office has declined to do so, and
    he had again approached
    to his head office.

    Till today i am getting phone calls from their various branches from
    all over india and they are verbally abusing and threatening and
    abusing me for false outstanding payments and more over they pleaded me
    for paying rs. 6000/- odd to close the chapter.

    Last week also one person came to my house in my absence and called in
    my names and my family members didn't open the door as they know this
    matter very well.

    Now i do not want get phone calls from your end and requesting you to
    cancel my card as i don't
    want their service.

    Furthermore as i have not purchased anything by using their card, i am
    not going to pay them any
    thing.

    you have to file an FIR against this case only then the action will be taken as it is a fraud done by some farudster and bank will not take any action unless FIr is lodged

    I have 2 HDFC bank Credit Cards ( 4346771007251292 ,5176358010515541 ). I hve been making regulatr payments , however for the last 8 months I have requested several times for a settlement for th ecards as I am going through a financial crisis.I hope that a person making regular paments for more than a yaer , I have already paid more than my credit limit without any benifit .
    This month when i recieved a call from the above mentioned agent I told him that I wanta settlement and would not be able to make the mimimum payment as everymonth I have been told to make the payment and settlement would be arranged for me , which never happened. So this person started talking rudely and said I have to make the payment and he will keep on disturbing me. I asked him not to call me , but he even started calling my home and abusing my family members .

    So I called up the helpdesk no at 44005391 and wanted to Speak to Ms Emon , she was not available and I spoke to Shilpi from her team , she told me that she would forward the request of settlement to chennai and I would not recieve calls from the person anymore . Next day I recieved a call from a lady who said she was the manager of the above mentioned agent and that there was no point escalating because it to come back to her .She even insisted me on paying the minimum amount and started blasting at me without understanding my problem.

    Afetr that yesterday the same person called me again , I told him that I have spoken to Ms Emon's team and she said that the case would be taken care of .Again today evening this person called me and told me that he found out that Ms Eman is not aware of anything and I would have to make the payment . So I told him do not disturb me as I was in the middle of something very important but he said he would disturb me . Then he satrted calling my home and started abusing my mother and suster in law and whatever possible language he could .

    Is this what the you call customer service? Your people does not know how to speak and they are not bothered if cistomers have spoken to to someone senior .This is what you teach your employees , how to behave with your customers ? Don t you have any kind of call monitoring system and Quality guidelines while speaking to the customers .How could your employes use abusive language with ladies and elderly persons ? This really calls for a step that customers should take against people harassing them

    I am still getting calls from the below mentioned collection agent . He called almost 100 times today. I then Called up Shilpi and informed her aout the same .THis person again called me and my home and spoke filthy words to my mother. He also informed me that by complaining , there would be no solution and that I have to make the payment else he would not stop calling . He kept on calling me and stated that I have chected banks money and that I have to payback . I again reminded him that the request for settlement for my card has been forwarded by Shilpi as she informed me , but this person said that I was lying about Shilpi and more unprofessional words. I think when your collection people are calling customers they are supposed to be professional but it seems that it is not with your bank . However I feel sorry that I have major accounts and other links with your bank which I would have to withdraw and also take this up with people who would be
    able to guide me . Because your employees don't even bother about complains , they are unprofessional and it seems there are no CODE OF CONDUCT maintained in your bank. This time this person started callin me from a different no so that his calls are not recored , or i think your bank does have the call recording system.

    Do i get any kind of response from any one from your bank regarding this issue ?

    It is very upsetting that your bank do not respond to important mails . Well I got harrased by your bank employee today over the phone as he called me up more tan 100 time and kept my phone busy from morning till 7 in the evening . He even abused my mother with filthy language .and still the bank is not responding . Are you trying the customers patience ? Well this is going to far and no one is responding to this as per the RBI regulation I am being verbally harrassed and being threatened . Your employee had the audacity of threating my mother saying that he his coming with police and would arrest my mother . This is really comtempt and I would go to the Court for Justice now .

    Hi,

    I have HDFC value plus credit card no xxxx xxxx xxxx 3570.
    My due date is 23rd of the month so I always drop a local cheque either on 20th or 21st of month. This time I made it on 21st Nov 09. It seems there has been delay from the bank side to collect the cheque from the drop box & they received the cheque on 26th Nov 09. As a result, they have imposed a late payment & interest charges of 800 INR on me. Well I feel I made the payment in time then why shall I pay for the late payment. Also Customer care folks argued with me.

    I am Deepak Kumar Jain from Bangalore. Recently i have applied for House Loan In State Bank of Mysore. I got the reply from bank my loan is not approved due to DEFALUT in cibil report. Further to this case as follows.

    I approach CIBIL ( My Control No with CIBIL is 41 01 34 821 dtd 09-11-2009) to get the infromation about the WRITTEN OFF ( Rs 1,02,435 dtd 14-08-2003 and Rs 1,78,401 dtd 18-09-2001) money from the bank. After 12 reminder in 20 days i got the reply from CIBIL as followis

    after getting the above information approach to HSBC Bank Basvangudi Branch and ask for the information they give us their E mail Id and told me to do the corrospondance through email.

    After doing the corrospondance with the HSBC bank they are asking for all type of information like PAN Cards Add Proof etc. My worry is that they may misuse the same to protect them. I am worrted with following concern.

    01. The above cards has been issed at Delhi Add. ( In my 38 Years of life i never stayed in Delhi as a resident.

    02. I never applied for Credit Cards in HSBC Bank.


    We need the solution for the above as my House constructiion is held up and incuring the heavy losses every day

    The complainant has prayed for the following directions to the opposite parties:-

    The case of the complainant is as under:-
    He is working for a private limited Company and residing at Bangalore. He availed credit card No. 4050 2820 0026 7851 from the opposite parties and the credit card was issued on his account No.00761000048331 with credit limit over lakh of rupees. He had been using the credit card for purchases and repaying the amount within the prescribed period till the year 2005. He had taken insurance policy and the premium in that regard was payable quarterly. He availed smart pay facility from the opposite party for payment of the insurance premium of Rs.2,500/- per quarter and he had 45 days time to make payment of the said amount to the opposite parties. The opposite parties were to make payment of Rs.2,500/- towards quarterly premium, but from the statement dated: 23.12.2005 he noticed that instead of Rs.2,500/- the opposite parties had paid Rs.5,033/- towards premium. Immediately he approached the opposite parties on various dates and informed that they had made payment of Rs.2,500/- in excess towards insurance premium and requested to sort out the issue.

    He made payment of Rs.3,013/- through cheque No.311895 being the remaining amount after deducting the additional amount paid by the opposite parties. He also requested the opposite parties to stop smart pay facility and as per the letter dated: 21.01.2006 the opposite party cancelled the said facility with effect from 18.11.2006. Since then he has been in constant touch with opposite parties seeking clarifications about the additional payment made from his account. But the opposite parties evaded the quires and have kept on charging interest and late fee on the said amount. Though he has paid the entire outstanding dues he was getting bills of payment of dues which were actually not due and payable by him. He addressed several e-mails to the opposite parties. After receiving the entire outstanding amounts the opposite parties never issued any letter of settlement. Since he was repeatedly calling and sending e-mails to the opposite parties one official called him over phone and requested to approach opposite party No.1 and to show the receipts regarding payments and to collect a settlement letter. When he approached opposite party No.1, he was made to wait for long hours and finally one of the customer care people informed that they would get back after they have the information, but so far no reply is given. The opposite parties had in fact freezed and were threatening to set-off the funds available in his SB account. The opposite parties issued letter dated: 04.11.2008 calling upon him to remit the alleged outstanding amount of Rs.21,866.77 paise within seven days failing which, the amount would be debited to his SB account as per the ‘cross default’ clause of the card member agreement.

    Thereupon he issued a legal notice dated: 12.11.2008 calling upon the opposite party not to forfeit the outstanding in the savings account. When he tried to contact the opposite parties in respect of the said letter one Gowda and another threatened him. Till date he has been receiving the letters, statements and SMS on his mobile stating that he has not paid the dues. He fails to understand that in spite of paying the entire amount his account shows an outstanding. The opposite parties have not only committed mistake in calculating the outstanding, but have forfeited the entire amount available in his savings account and have thus subjected him to lot of mental trauma and physical strain. Hence the complaint.

    2. In the version the contention of the opposite parties is as under:-

    Earlier the complainant had obtained a silver credit card with credit limit of Rs.65,000/- in the year 2005. Thereafter the credit card was upgraded to Visa- Platinum – Plus – Credit - Card with credit limit of Rs.1,55,000/- in the year 2007. The complainant had taken ‘Smart Pay Facility’ on the credit card to pay the insurance premium as and when demanded by the Insurance Company. Accordingly the amount was paid as per the demand made by the Insurance Company. They have no knowledge about the terms of the policy like the amount of premium and its period. They are only concerned with the payment of the respective demand made by the Insurance Company and they have promptly paid the amount towards premium.

    They have no knowledge that the complainant has to pay Rs.2,500/- towards quarterly premium. The complainant was required to implead the Insurance Company also as a party to the proceedings. As per the request of the complainant the Smart Pay Facility was cancelled with effect from 18.11.2006. From August-2008 the complainant is not making any payment though there is sufficient balance in his credit card account. As per the statement dated: 23.10.2008 the complainant is due Rs.21,866.77 paise and the complainant has not come forward to pay the said amount in spite of repeated request and reminders and has filed the present complaint without proper reasons. Since the complainant fails to make payment of the dues in spite of several requests and reminders they exercised right of “General Lien” on the amount available in the SB account of the complainant to an extent of Rs.18,140.43 paise with effect from 04.11.2008 and the same has been intimated to the complainant through notice dated: 04.11.2008 by which the complainant was called upon to pay Rs.21,866.77 paise. They have every right of exercising ‘General Lien’ as per the card member agreement.

    Therefore there is no illegality on the part of the opposite parties. The complainant is liable to pay the utilized amount by using the credit card. The complainant has not approached this Forum with clean hands and therefore not entitled to the relief prayed for.

    3. In support of the respective contentions, both the parties have filed affidavits, have produced documents and have filed written arguments.

    4. The points for consideration are:-
    (1) Whether the complainant has proved deficiency in service on the part of the opposite parties?

    (2) Whether the complainant entitled to the relief prayed for in the complaint?

    5. Our findings on the above points are in the Negative for the following:-
    REASONS
    POINT Nos. 1 & 2:-
    6. The complaint is filed on 18.12.2008 alleging that, as per the statement dated: 23.12.2005 the opposite party has paid Rs.2,500/- in excess towards the insurance premium under the Smart Pay Facility. If the complainant noticed excess payment made by the opposite party towards the insurance premium in the monthly statement dated: 23.12.2005, the cause of action to claim refund of the excess payment made accrued to the complainant on 23.12.2005. As such, the complainant was required to file the complaint seeking relief in respect of the excess payment within two years from 23.12.2005 as provided in Section 24 of the Consumer Protection Act. The complaint filed on 18.12.2008 is beyond the period of two years and as such, the claim of the complainant in respect of excess payment of Rs.2,500/- towards insurance premium is barred by limitation. The complainant has not even filed application for condonation of delay as required Under Section 24(A) of the Consumer Protection Act. Therefore this claim being barred by limitation the complainant is not entitled to that relief. However from the prayers made by the complainant in the prayer column it is evident that he has not prayed for any relief in respect of excess payment of Rs.2500/- made by the opposite party towards insurance premium. Except the details of the excess payment of Rs.2,500/- towards premium the other averments in the complaint are very vague. The complainant claims that he had paid the entire amount due and in spite of it, the opposite party sent the letter dated: 04.11.2008 demanding Rs.21,866.77 paise. But the date on which the entire amount due was cleared, and what is the amount paid towards full clearance of the dues is not disclosed. It appears in spite of repeated demands and requests the complainant failed to make payment of Rs.21,866.77 paise and therefore exercising the right of ‘General Lien’ the opposite party debited Rs.18,140.43 paise to his SB account as stated in Para-8 of the version. As per the terms of the Card Member Agreement which is extracted in Para-8 of the version the opposite party is entitled to exercise such Right of Lien on the amount available in the SB account of the customer who fails to clear the dues in his credit card account. If that is so, the act of the opposite party in debiting the amount available in the SB account of the complainant towards the amount due in the credit card account will not amount to deficiency in service. As such, we hold that, the complainant is not entitled to the relief prayed for. In the result, we pass the following:-
    ORDER
    7. The complaint is dismissed. No order as to costs.

    8. Send a copy of this order to both the parties free of costs immediately.

    9. Pronounced in the Open Forum on this 18th DAY OF MARCH 2009.

    Me and my family have been receiving harassing calls from HDFC BANK CREDIT CARD Recovery agents. I was jobless for 2 months, so I couldn't make any regular payment. They call me during odd hours, when I'm either sleeping or in the office. They don't talk they just call and hung up. They give 10-15 miscalls and when you callback no one answers the phone. They harassed my family member's. They talk is a very rude and abusive manner even if you're polite to them and they throw personal negative remarks on you. I just want to know what legal actions I can take against those people. I even have their voice recording in my phone which I can use as a proof.

    Hi,
    I am a HDFC platinum card holder. Recently when I checked my statement for the month of Nov-09 I found that there are 6 transactions in USD charged to my account. The transactions have been made somewhere in NJ USA. I have logged a complaint with the bank but there is no response. I would request you to suggest a course of action for me to follow.

    I am Raghavendra. I have hdfc credit card. I havent paid minimum amount due for 2 months. But they call me and harrass and they even use swear words as third rated bastards & where the fuck are you. This is disgusting. I know its my mistake of not paying but such professional organizations using such cheap words. Its disgusting. i want to get relieved from these people. I received call from 080 67139230 and the guys name is Tilak.

    i have hdfc bank credit card and also due of rs 42000 which is overlimit. all the month i pay minimum due but last two month i dont have money i cant to arrange for minimum money to pay hdfc credit bank a/c. yes i want to pay money but at this time i have some financeial problem at my home but hdfc collection they person call to me and tell me some non veg words. and also some tell to me if u r not paid all the money so we will break ur legs and hands. this type of calling to me so kindly i requeat to u what should i do??

    Dear sir,

    i had done settlement of my hdfc credit card on 7/02/2008 with the amount rs. 12500, which i paid to them through cheques. The executive with whom i have done settlement had said that now there is no any due from my side pertaining to this credit card. As we have done mutual settlement.

    Now almost after two years, when i have applied for another bank credit card, i have come to know that hdfc had given my info to cibil and the same has not been ractified even after the settlement. Now when i have contacted hdfc customer care department on 5/01/2010 to ask if any amount pending from side for my credit card, they said that my dues are clear and there is no outstanding from my side. Then i asked reason for not removing my name from cibil, then they gave me some other department's number and told me to do followup with them only.

    When i called the lady executive on that number, she took another 10 days to inform me the actual reason for not removing my name from cibil. Atlast when i has to lose my patience, she came with new matter that bank has to charge waiver amount fees and once i pay the amount then only my name will get out of cibil list.

    It was more shocking after two days when she told me the amount, which is now rs. 17000 i have to pay (for what reason i dont know) and then only i can be thankful to them for removing my name from cibil.

    1. My only concern is that at the time of settlement nobody has come front and told me to make any waiver payment, if it has to be.

    2. If i have done fair settlement and paid all the amount then why the bank is asking for any waiver fees.

    3. Is the bank has started to black mail consumers like us by illegally not removing name from cibil.

    Please let me know what can be done with my case.

    Respected Sir,

    I have my salary A/C. in HDFC Bank and my A/C. No. is 00901050350271 and Bank issued me Platinum Plus credit card 4050282002671340 against it, by this card I have paid 25000Rs. for insurance (Birla Sun Life). I want paid this amount in three EMI so when I contact to customer care they are not consider EMI facility . So please give approval for payment term through installments because I am unable to pay this amount in one sought

    04 Account No ( Card No ) 5548 3700 0976 1854 by HSBC Bank

    after getting the above information approach to HSBC Bank Basvangudi Branch and ask for the information they give us their E mail Id and told me to do the corrospondance through email.

    After doing the corrospondance with the HSBC bank they are asking for all type of information like PAN Cards Add Proof etc. My worry is that they may misuse the same to protect them. I am worrted with following concern.

    01. The above cards has been issed at Delhi Add. ( In my 38 Years of life i never stayed in Delhi as a resident.

    02. I never applied for Credit Cards in HSBC Bank.


    We need the solution for the above as my House constructiion is held up and incuring the heavy losses every day
